| 摘 要： | 刑法修正案(六)对公司、企业人员受贿罪作了重新界定,这样就使本罪的主体内涵扩大了,概念的表述也应随之进行调整.客观方面"利用职务上的便利"应理解为利用本罪主体现有职务上的便利,而不包括所谓"将来或过去的职务上的便利"."为他人谋取利益"应作为本罪的构成要件.

| Abstract: | Criminal Law Amendment(6) makes a new definition on the crime of accepting bribes of members of company and enterprise.So it enlarges the subject scope of the crime,and the presentation of the concept should be adjusted.On the objective aspect,"Make a profit for others" should be understand as take advantage of the subject's present position,and not include "the advantage of past or future position."make a profit for others" should be essential constitutive elements of the crime. |
