庭审直播中当事人隐私权保护研究

随着司法公开的推进,庭审直播已然成为审判流程公开的重要窗口。在司法公开带来积极社会效应的同时,庭审直播中当事人隐私权的保护却未引起足够重视。目前我国庭审直播中存在当事人的隐私权保护立法不完善、当事人缺乏对庭审直播的知情权、隐私权保护意识不强以及缺乏对当事人的救济等问题,需要通过完善庭审直播中当事人隐私权保护的法律规则、设置庭审直播告知程序、加强隐私权保护意识以及畅通当事人隐私权受到损害时的救济途径等措施对庭审直播中当事人的隐私权保护进行强化。

Research on the protection of the parties’ privacy rights during live court hearings

With the advancement of judicial openness,the live court hearing has become an important w indow for the opening of the trial process. While judicial openness has brought positive social effects,the protection of the parties’ privacy rights during live court hearings has not attracted enough attention. At present,there are issues in China’s live court hearings,such as imperfect legislation of protecting privacy rights,lack of the parties’ right to know the live court hearings,lack of aw areness of privacy protection and lack of remedies for the parties. Some measures can be used to strengthen the parties’ privacy rights in live court hearings,such as perfecting the legal rules for protecting the parties’ privacy rights,setting up procedures for notification of live court hearings,strengthening aw areness of privacy protection and smoothing out remedies for damages to the privacy rights of parties involved.
