| 摘 要： | 金融犯罪的共同犯罪数额应根据主犯与从犯分别认定,金融犯罪的共犯身份应根据必要身份和任意身份的不同性质分别认定,金融犯罪主观方面的“明知”和目的应根据刑法总则和分则的相关规定,并结合具体案情进行认定。
