| 摘 要： | 当前，构建刑事和解制度的呼声在我国越来越高。然而，刑事和解有其致命弊端。在我国，构建刑事和解制度实属无必要，刑事调解的实行表明其完全可以达到刑事和解应有的法律效果和社会效果．应通过完善刑事调解来取代刑事和解。

| Abstract: | There is a growing demand of establishing the system of Victim-offender Mediation in our country. However, many disadvantages of this system become increasingly prominent. Personally, I hold the idea that it＇s needless to construct this system in our country.The system of criminal conciliation can produce the same law and social effect as the system of Victim-offender Mediation does after years of implement. |
