关于测谎技术作为侦查手段运用的立法思考

测谎判断受施测人员、测谎设备、受测者和测谎环境等多因素影响,测谎技术对于案件侦破的积极作用有赖于运用的科学性和规范性。目前,建立测谎法制非常必要,法律规制内容应包括测谎人员的资格与地位、测谎机关、测谎实施的一般原则、测谎的适用范围和条件、测谎对象和操作程序,以及测谎结果的法律效力。

Summary of the Application of the Lie--detection Technology and Consideration on Its Usage as an Investigative Method in China

The lie-detection technology plays an active role in the criminal investigation. However.the application lacks of the legal restrictions for the time being.The qualification and status of the operator,the object,the gerneral principles and the scientific procedure are all needed to be regulated.Therefore,thispaper takes the technology as a kind of investingative method,and tries to do some research into the basic problems of its application, in order to do some good to its regulation.
