论中国民法典的体系

本文通过对民法典体系安排的各种观点从历史及比较法的角度进行分析 ,并从民法典制定当中民法调整的社会关系、民法典体系安排的标准以及民法典的内容、体系安排与社会变化三个方面加以论证 ,从而提出中国民法典应由通则、物权、合同、亲属、继承、知识产权、侵权行为等七编构成的观点。

On the Organizing Structure of Chinese Civil Code

This article analyses the should-be structure of civil code:there should be seven sections in the code,including general rules,property,contract,domestic relations,inherit,intellectual property,and tort.The article raises the points analyzing many points of view on the issue,through historic review and comparative study,and in terms of the social relations the civil law govern,the standards by which the civil law is divided into section and social development's influence to the division.
