中西经济法差异比较与我国经济立法的思考

经济法是调整在国家协调和干预经济运行过程中所发生的经济关系的法律规范的总称。中西经济法的基本特征是相同的 ,但它们之间仍有很多差异。西方经济思想史上 ,自由放任思想根深蒂固。政府的经济干预政策在我国则有悠久的历史传统 ,即使建国后 ,由于政治和经济等的影响 ,国家对经济的干预几乎是无所不在。本文从三个方面分析中西经济法的差异。

A Comparative Analysis on the Differences of Economic Law in China and Western Countries and the Thought of Economic Legislation of China

Economic law is the general title of legal regulations, which adjust the economic relation occurred during the economy operating process coordinated and intervened by the state. The essential characters of economic law in China and western countries are the same, but there are still many differences between them. Idea of freedom and noninterference was deep rooted in the history of economic ideology in western countries. But the economic interference policy does have a long history in our country. Even after the founding of PRC, owing to a lot of political and economic influence, the state interference existed almost in everywhere. This paper presents an analysis on the differences of economic law between China and western countries from three aspects.
