| 摘 要： | 从法律经济和实用分析,在少数民族聚居地区变通刑法是一条必然之道。以往的论者往往聚焦于群体的风习而对个人的权益关怀不够,变通刑法应当为受害的个体提供可选择的多渠道救济并加强普及宣传。从西部地区的民族分布看,变通刑法对保障西部大开发具有独特的意义。

| Abstract: | In light of legal economy and feasibility, it is imperative to be flexible in implementing the criminal law in ethnic minority areas. Past research tended to focus on the customs and institutions of the ethnic groups, neglecting the individual rights of the victim .To achieve flexibility in the implementation of the criminal law, we should make available to the victim different forms of legal aid, we should also try to enhance minority people's awareness. Considering the distribution of the ethnic minorities, it is of special importance to ensure flexibility in the implementation of the criminal law in our drive to develop the west. |
