| 摘 要： | 当前,经济犯罪和经济纠纷交叉案件是人民法院和侦查机关司法实践中困扰较多的一个问题。因此,有必要对最高人民法院法解《若干问题》进行修订完善。该司法解释主要应包括:1.要对经济犯罪与经济纠纷的内涵及两者之间的联系与本质区别作出一个准确界定。2.要对经济犯罪与经济纠纷的处理原则作出细化性规定。3.要使最高法的《若干规定》与公安部的《程序规则》统一协调。

The content includes: firstly, making a clear borderline of the relationship and theessence between the economic crime and dissension, Secondly, making a clear principle for dealingwith the cases on economic crime and dissension, thirdly, making the content in some principlerelated of the supreme count accordance with that of procedure principle of police. |
