对我国警察治安检查若干问题的思考

治安检查是公安机关维护社会秩序的重要手段，也是发现治安问题，堵塞治安漏洞，消除治安隐患的一种行政管理措施。公安机关在执法中常常将治安检查权等同于刑事搜查权，对公民权利造成严重侵犯。在警察检查权的制度设计中，应将公共领域的检查权与私人领域的检查权作明确的区分；在公共领域进行治安检查应当以保障警察执法效率为主，适用宽松的法律控制，当警察针对私人领域行使检查权时，应当适用严格的法律控制；从尊重和保护公民宪法权利的角度着眼，公安机关应完善场所检查和公民身体检查的规则。

Thought on the Chinese Police Public Order Inspection

Public order inspection is not only the important means that public security official organization maintenance social order,but also a kind of administration to discover public order problem,stop the public order loophole and dissolve public danger. The police usually confuse the administration inspecting power with the crime searching power. It is useful to distinct the private realm inspection with the public realm inspection. We should take the more strictly law control to face the private realm inspection to the public realm inspection. The public security official's organization should perfect the rule of the place check and the citizen physical examination in the view of respecting and protecting the citizen constitution right.
