| 摘 要： | 经济犯罪是指行为人在市场经济运行过程中,为谋取不法的经济利益,违反国家法律法规,依照《刑法》应当受到刑罚处罚的行为。现代经济犯罪的成因比传统刑事犯罪要复杂得多,经济体制改革、法制转轨.人口流动之类的社会因素均可能诱发各种各样的经济犯罪。经济犯罪具有极大的社会危害性:一起经济案件可能导致一个或数个企业陷入困境甚至倒闭;一些大案要案涉案资金数额巨大,给国家、集体和公民个人造成巨大损失;尤其是经济犯罪往往与腐败现象紧密相连,经济犯罪滋生腐败,腐败行为掩护经济犯罪,极易引发上访等集体性案件的发生,威胁国家政权的巩固。

| Abstract: | The economic crime refers to the act that the doer violates the laws to seek illegal economic profits, and should be punished by the criminal punishment according to Criminal Law.The causes of modem economic crimes are much more complicated than that of traditional criminal crimes.The social factors,such as the reform of economic system,the transition of legal system,floating of population,may cause all kinds of economic crimes, which are dangerous to the society. |
