| 摘 要： | 本文对最新颁布的《刑法修正案八》进行了评述,认为此次修正案对我国刑法的发展具有重大的意义,代表着刑法理性的回归。本文基于刑法理性三个方面的体现：节制性、目的性、合理性,对修正案的具体内容进行了分析,认为修正案关于死刑的修改、新罪的增加、刑罚的调整都体现了刑法理性的要求。
