| 摘 要： | 行政与刑事法治的起点应当是对警察权力行使的制度整合。鉴于警察权性质的强行政性、暴力性、扩张性和概括性,由此产生的制度规约就似乎不可避免的会面临两难境地,而我国现行警察制度也的确存在着种种弊端,要改变这种状况,必须对警察制度进行整合。而确权、限权与分权是警察制度整合措施的最终目的。

| Abstract: | The starting point of ruling by law on both administration and criminal should be the system conformity of police power.Because of the powerful-administration?violence?dilatation and condensation of police power,it seems that the system restraint would not avoid falling into a delimma.To avoid and cure kinds of malpractices in our current police system,we must take some measures to fasten the police system's conformity. |
