| 摘 要： | 近代以来关于自由的观念形成了两种基本的学说"消极自由"与"积极自由".消极自由是"免于……的自由",积极自由是"去做……的自由",确认和保障自由是法律的目的,民商法体现的是一种消极自由观,经济法则反映了积极自由的观念,是对民商法消极自由理念的超越.

| Abstract: | There are two main theories about the viewpoint of liberty in modern society:the active liberty and the passive liberty.Passive liberty is a kind of freedom which is free of doing sth,and active liberty is a kind of freedom to do sth,it's the target of law to affirm and ensure the liberty.The civil law has the viewpoint of passive liberty,and the economic law reflects the opinion of active liberty ,which is a transcend of the former. |
