第三人干扰婚姻关系损害赔偿责任的证伪

第三人干扰他人婚姻关系是否应当承担损害赔偿责任在我国长久以来一直存在争议。然而,通过对台湾法和德国法上两种完全不同的法律规定进行比较可以得知,第三人是否应当承担损害赔偿责任实际上是由一般社会观念及民众的价值判断所决定的。通过对我国现行法律中所体现的法律价值、第三人干扰婚姻关系制度的目的、负面风险的发生以及干扰婚姻关系行为的价值评判进行分析,笔者认为我国不应当要求第三人承担损害赔偿责任。与此同时,笔者也对受损害配偶受欺骗抚养非亲生子女的损害赔偿问题进行了分析。

Falsification of The Third Party＇s Damages who Disturbing Others＇ Marital Relations

The question of wether the third party who disturbs others＇ marital relations should undertake the damages is arguing in our country. However, the comparison of different provisions of Taiwan province and Germany give us a conclusion that it is determined by the common views and the judge of value of civilians. The value in our country＇s law, the main purpose of this system, the potential downside risk and the review to the action of disturbing others＇ marital relations determine that the third party should not assume the damages. Meanwhile, the questions about the compensation for one of the spouses who have been cheated to bring up non biological children also has .been discussed in this paper.
