| 摘 要： | 背信是人们违背诚实信用这一最古老的民商活动基本原则的要求的行为。市场经济就是信用经济，最近几年，背信犯罪增多，严重影响了我国经济健康快速发展，因此研究背信犯罪具有重要的现实意义。借鉴国外立法经验，定义背信犯罪，分析背信犯罪的犯罪构成，以区别背信犯罪与相关犯罪的界限，完善背信犯罪的处罚。

| Abstract: | Credit-violation means the people violate honesty and credit,and honesty and credit is the basic requirement when people carry ont he civil and commercial actions.The market economy is credit economy,but in recent years,the increasing credit-violation crimes badly affectsh ealthy and rapidly development of Chinese economy,so it has important realistic meaning to study the credit-violation crimes. |
