对聚众淫乱的民众态度调查

以对聚众淫乱行为的民众态度进行调查分析,为立法政策调整提供素材和依据为目的。采用问卷调查法,以大学生、城市居民、农村居民为对象展开调查。结果显示,对秘密聚众淫乱行为认为现行法规定适当的仅占21.5%,近八成的人认为秘密聚众淫乱行为不应构成刑事犯罪,对其不应处罚或给以行政处罚。对公然猥亵大多数人认为应当处罚,其中五成的人认为应当给以行政处罚,有二成的人主张应给以刑事处罚。从而得出民众对秘密聚众淫乱行为的处罚态度与现行法追究刑事责任的规定并不一致,对公然猥亵的容忍度非常低的结论。

Public Attitudes Survey to the Group Licentiousness

Objectives：To investigate and analyze the public attitudes to the promiscuous behavior and to provide material basis for legislation and policy adjustments. Means： Adopt the method of questionnaire survey, object to investigate for college students,urban and rural residents. Results： As for the group licentiousness,only 12.5% individuals consider that the punishment of positive law is advisable, nearly 80% respondent believe that it should not constitute a criminal o~nse of the secret group licentiousness and spare the rod or administrative penalty. To the flagrant indecency, most people consider that it should be punished and half of them advocate the administrative punishment and 20% of them claim to be penalized with criminal punishment. Conclusion：It does not come with the regulation and criminal responsibility of the public attitudes towards the secret group licentiousness and people keep a very low tolerance for public indecency.
