“指导性案例”的效力问题体现了案例指导制度的核心内容和本质特征。尽管没有法律拘束力,但“指导性案例”在行政审判活动中的效力是客观存在的。这种效力在形式上来源于法院内部上下级的监督关系,实则可进一步追溯至实践理性。随着案例指导制度逐步走向成熟,有必要通过创建案例分类指导制度对“指导性案例”的效力予以明确。

On the Validity of Guide Case in Administrative Litigation

The validity of guide case indicates the core and essence character of case-guiding system. Although it does not have binding force, guide case does impose some influence in actual judicial practice. The influence originates from the hierarchical system in our courts. Substantively, it can be traced to the practical rationality. With the case-guiding system developing, it is necessary to construct a classification system to define the validity of guide case.
