试论宪法观念的更新

宪法观念在宪政建设中有重要作用,也直接影响人们对宪法的性质、地位、作用的认识.因此,在中国实现宪政的过程中,首先应更新传统宪法观念.本文认为应从如下四个方面实现宪法观念的转变1、从政治化的宪法复归法律性的宪法;2、从宣言性的宪法到保障性的宪法;3、从权力本位的宪法到权利本位的宪法;4、从修宪型的宪法到解释型的宪法.

On Renovation of Constitutional Concept

The concept of constitution not onl y plays an important role in e stablis hment of con-stitutionalism,but also has an imme diate influence on pe ople' s understanding of constitution,in cluding its nature,status and functio n.As a result,what should be updated first in the course of realizing constit utionalism in China is none o ther than our traditional concept of constitution .The essay argues that efforts should be made to update our concept in four asp ects as follow s:a )from a politicized con-stitution to a legal constitution ;b )from a constitution that is set up as a declaration to a constitution tha t could be put into action;c)from a constitution based on power to a constitut ion based on rights;d)from an amendment constitution to an interpretation cons titution.
