| 摘 要： | 就《最高人民法院关于审理船舶碰撞纠纷案件若干问题的规定》所涉及的一些问题进行评述，包括船舶碰撞纠纷案件适用的准据法、比例过失原则、责任主体等，指出该规定重塑了比例过失原则，发展了中国船舶碰撞法，澄清了审判实践中的一些长期未决的问题。

| Abstract: | The author discusses a number of issues covered by the Supreme Court's Rules of Trials on Collision Cases,including the applicable law of collision disputes,the comparative negligence rule,the liable party,etc,points out that the judicial directive which has re-stated the comparative negligence rule is the recent development of the Chinese law of collision at sea,which have solved some long-standing problems whilst creating some others. |
