| 摘 要： | 我国农民权利保护研究表明，农民权利保护应当重新树立权利理念、建构权利保护内容。农民权利保护产生的特殊历史原因和现实状况，使当代中国的农民权利保护在权利主体、现实条件和权利保护目标等方面具有与其他群体权利保护不同的特殊性，从而决定了农民权利保护内容的复杂性。农民权利保护的内容应当分为三个层次：人权层面上受到平等对待和尊重的权利，农民作为公民享有的基本权利以及在特殊条件下急需特殊保护的权利。
