| 摘 要： | 引进西方国家的辩诉交易制度,还是完善发展我国“坦白从宽”的刑事政策,是摆在理论界和司法实践面前的选择性命题。通过对两者的比较,得出这样的结论：移植“辩诉交易”不可行,“坦白从宽”法制化是当然选择。

| Abstract: | It is a hard choice for theoretical circles and jucicial practice whether to introduce the plea bargain system in western countries or to improve and develop the criminal policy "leniency to those who confess their crimes" in our country.We come to a conclusion that to introduce the plea bargain system is infeasible and the legalization of "leniency to those who confess their crimes" is our natural choice by comparison. |
