窃取、收买、非法提供信用卡信息罪疑难问题研究

窃取、收买、非法提供信用卡信息罪是《中华人民共和国刑法修正案（五）》（以下简称《刑法修正案（五）》）的新增罪名。它的出台结束了我国刑法领域长期以来对于以信用卡信息为犯罪对象的行为无法适从的局面,这将有助于从源头上遏制日益猖獗的信用卡诈骗犯罪活动。但是由于本罪名出台时间较短,司法实践经验积累不足再加之无相关配套的司法解释,造成在司法实践中关于如何认定本罪出现了很多分歧和争议,导致司法实践行为的不统一。本文从犯罪主观方面的认定、信用卡信息的内涵与范围以及接受他人无偿提供信用卡信息行为的归罪问题三个方面对当前司法实践过程中出现的疑难问题进行深入研究。

Problems of the crime of stealing,buying and illegally providing credit card information

The crime of stealing,buying and illegally providing credit card information is the new crime by＂Criminal Law Amendment of the People＇s Republic of China（Ⅴ）＂（hereinafter referred to as ＂ Criminal Law Amendment（Ⅴ）＂）.Its introduction ended the situation that our criminal law hasn＇t long been applicable to the behavior of taking the credit card information as the crime object,which would help to contain the source of rampant criminal activity of credit card fraud.However,due to the shorter time of the introduction of the charge,less accumulation of judicial experience coupled with no supporting judicial interpretation,there have been many controversies on how to identify the crime and in the judicial practice,leading to disunified acts of judicial practice.The paper from the subjective identification of the crime,the meaning and scope of credit card information,and the behavior of accepting the credit card information provided without compensation to analyze in depth the difficult issues in current judicial practice.
