This notice rescinds the guidelines that we published in the Federal Register on October 3, 1994, that required States to document equal access to immunizations for Medicaid children if States elected to use lower vaccine administration fees than the maximum charges that were published and applicable under the Vaccines for Children program. These guidelines are rescinded in response to public comments on the October 3, 1994 notice. States indicated that there were numerous problems regarding the collection of useable data.     

Voluntary protection programs to supplement enforcement and to provide safe and healthful working conditions--OSHA. Notice of implementation of revised voluntary protection programs

OSHA announces the implementation of three Voluntary Protection Programs. The programs, revised from the January 19, 1982, notice in the Federal Register (47 FR 2796), seek out and recognize exemplary safety and health programs as a means of expanding worker protection. Companies, general contractors, and small business organizations which meet specified programmatic safety and health criteria, which go beyond OSHA standards in providing safe and healthful workplaces for their employees, and which want to do more than is required to help the agency accomplish the goals of the Act are the applicants OSHA seeks for these voluntary programs. In return, OSHA will remove participants from general schedule inspection lists and give priority attention to any which request a variance. The programs are called "Star." "Try," and "Praise."     

Health Resources Administration--Hill-Burton "uncompensated services" assurance; priorities for handling complaints. Notice

This notice announces the establishment of priorities for handling complaints of noncompliance by assisted medical facilities with their "uncompensated services" assurances under Titles VI and XVI of the Public Health Service Act. The priorities will determine the allocation of the Department's investigative and decision-making resources to certain complaints where the resources available are insufficient to handle all complaints.

《电子商务法》“通知—删除”规则呈现出滥用和错误通知概率高,损失风险大,实质作用可能得不到发挥等问题,源于其对电商知识产权侵权治理效果的积极追求,以及因此形成的对传统“通知—删除”思路的改动式借鉴——允许在认为侵权情况下发出通知但不提供恢复选择,结果是这一“通知—删除”规则不具备诉前禁令的条件却具有类似的效果。现有完善思路意图让这套规则更接近真正意义的诉前禁令,却因忽视了两者的本质区别而难有成效。电子商务治理应该注重发挥利用平台的管控力,基于此形成的平台自治能够通过平台的实质性介入引导纠纷解决和提高处理效率,从而控制滥用、降低风险,缓解规则存在的弊端。实现平台自治一方面需要在不违背法律价值和不降低法律要求的前提下通过“约定—同意”的方式探索自治空间;另一方面需要在规范层面赋予平台一定的自治权限,让平台有权根据实际情况在收到反通知后确定采取必要措施的期限。     

“互联网条款”对于新类型网络服务的适用问题——从“通知删除”到“通知加采取必要措施”

"通知删除"规则率先确立于《信息网络传播权保护条例》,《侵权责任法》"互联网条款"将其扩展为"通知加采取必要措施",并使其广泛适用于一般网络侵权领域。《电子商务法》知识产权保护条款又有相应的规定。随着互联网技术和商业模式迅速发展,新类型网络服务层出不穷,在适用"通知删除"等规则中不断产生新问题和新争议。除另有特别规定外,新类型网络服务应当适用《侵权责任法》第36条规定的"通知加采取必要措施",其中"必要措施"的界定具有开放性和灵活性,"必要措施"的妥当性取决于与特定网络服务的匹配性,可以根据网络服务提供者的具体情形,以利益衡量的方式确定相应的具体措施。个案中应当根据新类型网络服务的特性以及产业发展需求等情况,合理权衡特定网络服务与"必要措施"的适应性,妥善确定应当采取的"必要措施"。

Section 602 of Public Law 102-585, the "Veterans Health Care Act of 1992," enacted section 340B of the Public Health Service Act ("PHS Act"), "Limitation on Prices of Drugs Purchased by Covered Entities." Section 340B provides that a manufacturer who sells covered outpatient drugs to eligible entities must sign a pharmaceutical pricing agreement with the Secretary of Health and Human Services in which the manufacturer agrees to charge a price for covered outpatient drugs that will not exceed an amount determined under a statutory formula. The purpose of this notice is to inform interested parties of final guidelines regarding new drug pricing.

The Food and Drug Administration (FDA) is announcing in this notice a statement of policy concerning interim guidelines for the nutrient composition and nutrient levels in infant formulas. The recommendations on standards for nutrient levels in infant formulas made by the Committee on Nutrition of the American Academy of Pediatrics in 1976 should be followed by infant formula manufacturers as interim guidelines until revision in the existing infant formula nutrient composition regulation (21 CFR 105,65) is completed.

The Ryan White Comprehensive AIDS Resources Emergency (CARE) Act (Pub. L. 101-381) includes provisions for emergency response employees (EREs) who may be exposed to potentially life-threatening disease during the course of an emergency. This notice sets forth the final list of diseases to which these provisions apply; final guidelines describing circumstances under which exposure to listed diseases may occur; and final guidelines for determining whether an exposure to the listed diseases has occurred. The final list of diseases and guidelines incorporate comments received by CDC on a draft list and guidelines (57 FR 54794, November 20, 1992).
