Forensic medical evaluation of harm severity inflicted to one's health by slight craniocerebral injuries in the remote period

A pressing problem is discussed: forensic medical evaluation of harm inflicted to health by slight craniocerebral injuries. Analysis of 2150 expert forensic medical and medico-social conclusions revealed serious organization and methodological errors in evaluation of harm inflicted to health by slight craniocerebral injuries. Approaches to improving the quality of such forensic medical expert evaluations are outlined.     

Basic approaches to medical,forensic, and biomechanical studies in expert evaluation of a car injury

Modern approaches to forensic medical expert evaluation of car injuries are discussed. Many problems remain unsolved after examination of injuries in victims inside the car, which negatively tells on the versions suggested during criminal investigation of car accidents. The experts often neglect the most sensitive methods for evaluation of these injuries and many fundamental approaches to the problem: differential diagnosis of primary and secondary injuries; basic medical and biomechanical methods and studies of the clues; fundamentals of total systems evaluation of the results of forensic medical expert evaluation.     

The forensic medical expertise of the victims of large-scale fires]

The difficulties of present-day forensic medical expert evaluation of poisonings in fires are explained by exposure of man to highly toxic compounds that form during burning of polymers. Analyzing forensic medical expert evaluations of a large number of victims dead in a large-scale fire, the authors emphasize the necessity of measuring not only dead people's blood levels of HbCO, but of some other toxic combustion products that may exert combined effects on human body. The authors think it desirable that criteria of forensic medical evaluation of combined poisoning in fire be defined.     

The cost price of expertise as an objective index of the work-share coefficient of the forensic medical expert]

The author suggests a method for estimating the net cost of a forensic medical expert investigation, consisting in calculation of an objective real coefficient of the ratio of various expert investigations to the reference value. The ratio between forensic medical investigation budget and the total number of these investigations forms the basis for the estimation of the net cost of an expert evaluation.     

Organization and procedure of forensic medical expert evaluation of professional working capacity loss

Sixty-one forensic medical expert conclusions on the loss of professional working capacity are analyzed and typical errors are characterized. The procedure of forensic medical expert evaluation of the degree of loss of professional working capacity in accordance with the Civil Code and Civil Judicial Procedure Code of the Russian Federation and the actual norm-setting documents is described.     

Criteria for forensic medical evaluation of professional working capacity loss

The main and additional criteria used in evaluation (in percent) of loss of professional working capacity are characterized. Criteria common for forensic medical and medical social expert evaluations and differences between them are discussed. These differences are due to the fact that forensic medical expert evaluations are based on the Civil and Civil Processual Codes of the Russian Federation but not on the departamental norm-setting documents.     

Defects in medical care rendered by private practitioners (or institutions)

Fifty-one conclusions of forensic expert medical committees on criminal and civil cases instituted against private medical institutions and physicians are analyzed. Sixteen expert evaluations concerned dental care, 15 were on cosmetic operations, etc. Flaws in medical care, their causes and consequences are analyzed. Tentative expert evaluation of similar cases is made.     

Expert evaluation of damage to health in dental injuries

Discusses problems in forensic medical expert evaluation of the severity of dental injuries. Analyzes the classification of dental injuries and criteria for their expert evaluation. Considers some disputable and contradictory problems in expert interpretation of dental injuries involving complete loss of teeth and evaluation of injuries in subjects with maxillodental diseases. Offers approaches to solution of these problems.     

The methodological basis for the expert assessment of unfavourable outcomes of the treatment

Procedures of forensic medical examination are considered with special reference to the cases of unfavourable outcomes of the treatment and methodological basis of their expert assessment. The step-by-step analysis of the doctor's actions is proposed for their objective evaluation. The objective opinion of the expert commission should be based on the medical criteria for the doctor's actions.     

On the state of the budgetary funding of government forensic medical expert institutions in the Russian Federation

The data on the budgetary funding of state-owned forensic medical bureaus in the Russian Federation for the period from 2005 to 2008 were collected and analysed. The results of the overall estimation and parameters characterizing the level of funding of these expert facilities are presented. Selected state forensic medical bureaus have been ranked based on the level of their financial support.     

Difficulties in forensic medical evaluation of some forms of craniocerebral injury

Conclusions of 41 repeated expert evaluations of craniocerebral injuries within the framework of criminal and civil cases investigation are analyzed. Some aspects of clinical and forensic medical diagnosis of lethal and nonlethal injuries to the head, evaluation of the quality of medical care, and qualification of the severity of harm to health are discussed. Causes of typical expert errors and approaches to their prevention are shown.

医疗损害鉴定主体改革刍议

医疗损害鉴定主体,包括鉴定机构及鉴定人,是医疗损害鉴定制度改革的起点。医疗事故鉴定模式中的专家组并不是鉴定主体．但其合议制的实质对鉴定结论的科学性具有重要作用,应予保留。应改革鉴定结论形成机制,允许出具多样化的鉴定结论。医疗损害鉴定制度的改革应采取司法行政部门主管、司法鉴定机构组织鉴定工作、医学会推荐鉴定人的模式。由于医学的专业性极强,鉴定人应当来自于现任专职医务人员。在保证鉴定人中立性、公正性的同时,要重视保证医务人员参与鉴定工作的积极性。     

Utilization of complex technologies of molecular genetics for forensic expert identification of unidentified remains of victims of terrorist acts in Moscow in 1999

This paper presents the first experience gained in Russia in expert identification practice with complex utilization of technologies of molecular genetic individualization of biological objects for solving identification tasks requiring the maximum complete armory of mutually supplementing means. This is particularly important for forensic expert personality identification in cases with many deaths, when indirect identification has to be resorted to, consisting in the use of biological samples from relatives of the victims as the identifying objects. Methodological approaches and concepts of expert studies, used for identification of the remains of people who died in terroristic acts committed in Moscow in September, 1999, are discussed. The results of this study and methodological experience notably extend the potentialities of expert evaluation as regards forensic medical identification of victims of overall disasters, terroristic acts, and war conflicts.     

Forensic medical examination in cases of sexual abuse

The article presents the analysis of forensic medical expert practice in the field of sexual abuse. Drawbacks in expert examinations, official decisions on such examinations, low expertise of forensic medical personnel in sexual crime, lack of tools for genital and anal examination are analysed and methods of correction of this situation are proposed.     

Forensic medical significance of anti-P1 immunoreagents with incomplete antibodies in blood analysis

Anti-P1 immunoreagents with incomplete antibodies are intended for detection of antigen of different degree of manifestation in blood traces during expert evaluation of material evidences by the adsorption-elution test. These reagents can be used for detecting weakly manifest P1 antigen in liquid blood in forensic medical studies.     

The sick accused: forensic and emergency aspects in the courtroom

Evaluation of the fitness of an accused person to participate in legal proceedings is a classic forensic activity. Before the trial, the forensic expert will already assess any preexisting somatic and psychological illnesses and give a written expert opinion describing the condition of the accused at the time of the examination and assessing whether he is fit to stand trial. Nevertheless, decompensation or aggravation of a disease may occur--especially in stress situations as they are to be expected for an accused in the courtroom--so that apart from the current evaluation of the state of health of the accused, emergency treatment may occasionally become necessary in the courtroom. The article tries to answer the question how the expert can meet this challenge.     

Morphometry of cerebral neuroglial complexes in forensic medical diagnosis of substance abuse

A method of morphometric evaluation of neuroglial complexes of the brain by relatively simple and available morphometric technique is described. The gist of the method is measuring the glial distance and glial density, which change during narcotic intoxication and abstinence. The method is addressed to forensic medical expert histologists engaged in microscopic diagnosis of such poisonings on section material.

The notion and classification of expert errors

The author presents the analysis of the legal and forensic medical literature concerning currently accepted concepts and classification of expert malpractice. He proposes a new easy-to-remember definition of the expert error and considers the classification of such mistakes. The analysis of the cases of erroneous application of the medical criteria for estimation of the harm to health made it possible to reveal and systematize the causes accounting for the cases of expert malpractice committed by forensic medical experts and health providers when determining the degree of harm to human health.
