On restorative justice practiced in China

The victim-offender reconciliation (VOR), practiced by the basic public security, procuratorates and courts since the advent of 21^st century, is a new mode different from the mediation or conciliation in the procedure of civil litigation or of that accessory to the public prosecution in criminal proceeding. This mode connects the criminal justice with the mediation or private reconciliation by themselves. Thus, non-official settlement can influence the criminal justice and the decisions of authoritative agencies. It is beneficial to restore the victim’s interests, urge the offender to repent for his wrongdoings, compensate for the victim’s loss and restore the damaged social relationship. The VOR in China is the same in essence as the Western restorative justice, so it could be regarded as a Chinese mode of global restorative justice movement. Though the VOR mechanism works well, it still brings some matter in further consideration: (a) the legitimacy of VOR; (b) the conflict against the basic concept of crime; (c) the effect to the social reality.

本文侧重论述了未来民事诉讼模式的建立问题。文章认为,长期的职权主义或超职权主义现象应当结束。根据中国的国情、民事诉讼与生俱来的社会公益性以及各国改革的经验,未来的民事诉讼不应该是纯粹当事人主义而应该是协同型民事诉讼模式。     

Territorial Polarization in Brazil's 2014 Presidential Elections

The 2014 presidential elections showed a growing political polarization based on regional differences in Brazil. Against this backdrop, President Dilma Rousseff was re-elected by the slimmest margin ever obtained by a Brazilian president. Rousseff's Workers’ Party (PT) has held the presidency for the past 12 years, gaining widespread support for reducing social inequality and maintaining macroeconomic stability in the country. However, as the latest presidential elections show, this support for the PT and its presidential candidate has eroded. This article argues that as a result of fiercer competition for votes, a more politically polarized discourse was used in the presidential campaign to mobilize voters around Brazil's regional divide between the richer south and the poorer north. In the analysis, the article attempts to elucidate possible causes of territorial patterns of voting in Brazil's 2014 presidential elections.     

Beyond Countering Iran: A Political Economy of Azerbaijan-Israel Relations

In recent years, Azerbaijan–Israel relations have come to the foreground of politics in the Middle East and Caucasus region. Ties between Baku and Tel Aviv have been directly interlinked with their relations with Iran. The nature of the Azerbaijan–Israel partnership must be analysed in order to comprehend the balance of powers and energy security in the region. Even though there have been a number of works analysing the relationship by focusing on its role in regional military security, there is a gap in the discourse in terms of understanding the economic drivers of relations and the implications of the ties for regional energy security. Particular attention will be given to discussing Azerbaijan’s emerging role as a major energy producer that has already made a profound impact on the region as an ‘alternative’ to Iran in the aftermath of the recently imposed sanctions on Tehran's energy exports. It will be argued that the Azerbaijan–Israel relationship is built on solid economic grounds and it would be reasonable to expect the strength of the ties to be further intensified in the future. The article will also demonstrate that new developments in the energy security of the wider Middle Eastern region will affect the evolution of Azerbaijan–Israel ties and their rivalry with Iran in the next decade.
