Despite the spectacular development in the field of international criminal law, critical feminism stresses the narrow scope of the sex and gender crimes in the Rome Statute establishing the first permanent International Criminal Court. The current international criminal law discourse, as expressed by recent case law, is geared towards the protection of certain groups targeted on account of their distinctiveness within the framework of a conflict situation, and gender is not recognized as one of these group identities. The question whether international criminal law on sexual violence applies only to inter-group conflicts brings to the fore an uneasy likelihood of exclusion of some recently emergent situations where identities of the conflicting parties transcend a particular ethnicity or nationality, and where victims of sexual violence belong to the same group as their perpetrators. The article argues that, rather than the Rome Statute or newly introduced rules and regulations, a significant obstacle in developing gender justice is the narrow interpretation of sexual violence to inter-group hostilities.  相似文献

Examining the urban arts in the UK, in their paint and fibre-based alternatives, this article aims to account for the differences in contemporary dealings with graffiti and yarn-bombing (kniffiti). The intersectional complications of gender, race, age and class, as they have come to bear on the visual arts, as well as the historical power structures that have determined the classification of crime, and of art, are offered as possible rationales for present-day handling of ‘deviance’ in the form of urban art. It seems that urban knitting has blind-sighted both social conventions and legal principles in a way that exposes the arbitrary nature of both.  相似文献

Transparency has recently become a widely supported norm of information regulation within and among states. Transparency may be a widely accepted element of good governance, but it has a number of dimensions and manifestations. This article is among the first to examine the relationship between public sector transparency at the domestic and global levels. While the extant literature suggests that we should expect a strong relationship between the degree of a jurisdiction’s domestic and global commitments to public sector transparency, our sample of the 33 jurisdictions for which data are available finds no such correlation. The article develops an explanation of this unexpected finding, which highlights the varied incentives to implement transparency-promoting reforms that different jurisdictions experience. This analysis suggests that many developing countries engage in marginal participation across regimes. More concerning are possible cases of mock compliance where states participate in transparency regimes without the intention of fully implementing their commitments. Mock compliance is of particular concern in the sphere of global governance in which sovereignty is contested and compliance mechanisms face unique challenges.  相似文献

文章采用文献研究的方法对83份P2P网贷平台构成非法吸收公众存款罪的裁判文书进行实证分析。通过对平台异化模式的定性分析和平台负债情况的定量分析以及与刑事责任程度的交叉分析,文章认为,平台异化是P2P网贷平台构成非法吸收公众存款罪的基础性因素,负债规模、存款人人数和无法清偿的数额等三个因素都对刑事责任的程度产生影响。而且相比之下,无法清偿的数额对刑事责任影响的程度最为显著。实际上对P2P网贷平台追究非法吸收公众存款罪的刑事责任是因为网贷平台无法清偿举债数额巨大,即因债致罪。这种因债致罪的司法行为逻辑,可以从司法者作为“清场者”的功能定位和对社会秩序的价值追求来解释其合理性,但是从多元价值权衡和刑事民事分离的角度分析,其又是不合理的。  相似文献

International criminal tribunals are weak institutions, especially since they do not have their own police forces to execute arrest warrants. Understandably then, much of the existing literature has focused exclusively on pressure from major powers and on changing domestic politics to explain the apprehension of suspected war criminals. In contrast, this article turns attention back to the tribunals themselves. I propose three ways in which the activities of international criminal tribunals impact compliance with arrest warrants: through the selection of individuals to indict, demonstrated leniency on some suspects and outreach to domestic legal professionals. Using a duration model that accounts for sample selection and data collected on the International Criminal Tribunal for the former Yugoslavia and the International Criminal Tribunal for Rwanda, I test these theories alongside other existing explanations. I find that court activities can have an independent effect on the successful implementation of international criminal law.

针对启动事由在法条规定的基础上,提出涉案未成年人基于自己的权益需要也应赋予其信息调查的申请启动权,另外相关未成年人的社会保护团体在面临特殊情况时也可建议涉案未成年人或者公检法启动信息调查。在信息调查主体方面提出参照先前司法解释,由公检法三机关协商共同委托社区矫正工作部门来进行信息调查。最后提出在信息调查的内容方面要与司解内容相对接,与试点经验相融合,与身心特点相协调,与嫌疑罪名相对应的构想。  相似文献
