刑事案件笔迹鉴定样本收集规范探析

刑事案件侦破、审理过程中，往往需要通过笔迹鉴定对专门性问题作出鉴别与判断。刑事案件侦破、审判过程进行笔迹鉴定时，必须重视规范收集符合鉴定要求的样本材料。司法实践中，由于委托机关中的具体办案人员往往不具备文检专业知识，收集程序、方法不甚规范，无法有效保证样本材料的质量，从而导致样本材料不符合鉴定要求，最终影响到鉴定意见的准确性、可靠性。规范笔迹样本的收集工作，能够使之符合鉴定实践的要求，有利于保证鉴定意见的合法性、准确性以及可靠性。     

The shadow block: Female bonding in quilters

In these brief notes, the author's aim is to situate Born in Flames historically, including within the history of feminist theory. His starting point for thinking through this film was the presumption that what it means now differs from what it meant in its own time. While that would be true of almost any text, it has seemed to the author that Born in Flames, as an incendiary text, is extraordinarily provocative in the very ways that make it now seem “dated.” It remains inspiring, however, because it offers a vision of intersectional political coalition more radical than any feature film that we are likely to see now, despite the influence of decades of feminist, queer, and critical race studies. Revisiting the discourses the film generated at the time of its release, the author has come to recognize that, though times and the trends in theory have changed since 1983, the stakes of the revolution in the film have not. It presents a desire to make the world otherwise, economically and culturally.

我国视频侦查工作的实施状况包括投入与效果两个层面。周克华案、波士顿马拉松爆炸案、伦敦地铁爆炸案中的案件基本参数状况、资源投入状况与收益状况是评价视频侦查工作实施状况的具体指标。视频侦查工作效益最优是指在视频侦查资源成本投入一定的情况下实现侦查效益的最大化。视频侦查工作效益最优的经济学模型包括理想与现实状态两种函数。视频侦查工作的效益最优还应当兼顾法学与社会学领域的内容。效益最优视角下的我国视频侦查工作进路是一种体系化的工作形式,由原理、硬件、人员与机制四个层面的内容组成。     

刑事错案纠正的偶然性

我国设置审判监督程序的目的在于尽可能及时、有效地发现、纠正错案,弱化错案的消极影响,然而事实证明,依靠申诉启动再审程序的结构性缺陷、司法机关自主纠错的动力受限、司法人员主动纠错的内在症结导致审判监督程序四种救济途径在纠错方面的整体性失灵,引发错案纠正呈现为一种偶然性的现实,违背立法对审判监督程序的价值期待。     

网络传播淫秽电子信息犯罪的治理对策

文章围绕网络传播淫秽电子信息犯罪的治理问题展开论述,阐释了此类犯罪所触犯的刑法罪名及其相关的司法操作,分析了此类犯罪的危害性、犯罪行为特点以及犯罪主体特点,提出了严厉打击淫秽网站、加强相应的道德引导和法制教育、切实加强网络管理与监控、切断非法利益生成链条等综合性的治理对策。

Tradable Permits for Common‐Pool Resources: An Assessment

Scholars often attribute deterioration in common‐pool resources (CPRs) to ill‐defined property rights and suggest privatization and tradable permit markets as a solution to the commons problem. CPRs are heterogeneous, differing in physical characteristics and use patterns. Regulating their use requires tailored policy solutions that cohere with these characteristics. This paper examines factors that contribute to a well‐performing tradable permit market. While the literature offers rich empirical analyses of individual tradable permit markets, it has not provided an analytical framework enabling comparative analysis of these markets. This paper develops and employs an analytical framework for comparing across markets. The comparative analysis of market performance suggests that markets are not successful in all environmental problems and all demand situations. Further, it shows that even some markets frequently cited as exemplary successes have been that for nonmarket‐related reasons. On the other hand, this comparative analysis identifies sources of success for markets that partial analytical frameworks would have predicted to fail.

我国产业结构调整与人口迁移研究--配弟-克拉克定律的实证分析

按照配第—克拉克定律,我国产业结构的变动已引起了人口分布的大规模迁移,出现了从第一产业"溢出"剩余人口的潮流。没有这样的人口"溢出"或者说人口分布的变动,我国的产业无从发展,结构也难以调整。顺应产业结构调整和人口迁移发展趋势,借鉴世界各国的经验,通过有力的政策引导,改革开放的成果才能得到巩固。
