转型时期中国社会公共安全体系构建

中国目前的社会公共安全体系已经不适应社会转型期市场经济和社会公众的要求 ,有效的体系是国家体制与公共服务体制的统一体 ,而市场化和社会化是当前公共安全工作发展的趋势。社会公共安全体系发展趋势应以我国社区治安为基础 ,发挥公众和社会组织的功能 ,重新整合公共安全要素 ,在中国公共行政制度创新的压力下 ,构建一个政府管理与公众参与相结合、社会化和市场化相结合的新型社会公共安全体系。     

论社区警务的社会化

警务概念的外延扩大与模糊 ,使得传统警务概念受到了极大冲击 ,社区警务社会化也将成为警务工作发展的趋势 ,私人警务的扩展、警务多样化的形成 ,是历史发展的必然 ,也是国家和社会改革的必然要求。警务社会化是警务战略转型的结果 ,更是社会整体结构转型的必然选择。

南亚水环境治理困局及其化解

近年来,南亚国家围绕水环境治理取得了一系列进展,不仅加大了双边合作力度,而且为南亚地区进一步合作开发水资源夯实了基础。但由于各国发展阶段与经济实力差异等原因,在水环境治理方面面临短期方向不明、动力不足等难题。此外,南亚地区的水资源争夺严重伤害了国与国之间的感情,成为当前南亚地区关系紧张的催化剂,而国际社会参与南亚水环境治理开发,大国博弈又加剧了地区矛盾。当前,南亚国家在水环境治理合作的道路上可谓一波三折。南亚地区特殊的"历史记忆"导致彼此间命运共生理念认同难度大,"战略互信"的缺失又制约着国家层面友好关系的拓展。以"命运共同体"理念为指导,进而通过"共情"行动来积极推进南亚水环境治理合作,不仅有助于培育国家间感情,也有助于推进水环境治理综合机制建设乃至实现地区整合发展。同时,亚洲有关各方也应该抓住南亚社会经济整合转型的机遇,以参与水环境治理为契机,进一步通过"共情"实践推动南亚经济治理向着更加合理的多边合作态势发展,形成彼此间新形势下的相互依存关系,最终促进南亚地区的整合发展与地区繁荣。     

The Stagnation in Terrorism Research

Despite over a decade of government funding and thousands of newcomers to the field of terrorist research, we are no closer to answering the simple question of “What leads a person to turn to political violence?” The state of stagnation with respect to this issue is partly due to the government strategy of funding research without sharing the necessary primary source information with academia, which has created an unbridgeable gap between academia and the intelligence community. This has led to an explosion of speculations with little empirical grounding in academia, which has the methodological skills but lacks data for a major breakthrough. Most of the advances in the field have come from historical archival research and analysis of a few field interviews. Nor has the intelligence community been able to achieve any breakthrough because of the structure and dynamic of this community and its lack of methodological rigor. This prevents creative analysis of terrorism protected from political concerns. The solution to this stagnation is to make non-sensitive data available to academia and to structure more effective discourse between the academic and intelligence communities in order to benefit from the complementary strengths in these two communities.     

The compliant court — Procedural fairness and social control in compulsory community care

Compulsory community care (CCC) was introduced in Sweden in 2008. This article investigates all written court decisions regarding CCC over a 6 month period in 2009 (N = 541). The purpose is to examine how the legal rights of patients are protected and what forms of social control patients are subjected to.     

Hands‐Off or Hands‐On?: Deconstructing the ‘Test‐Case’ of Re G within a Culture of Children's Rights

This note challenges the so‐called ‘test‐case’ status of Re G in so far as it attempts to overturn the principle established in Re T that courts should adopt a neutral position when it comes to weighing the merits of different upbringings and the education provided by parents of minority religions. In determining the future upbringing and education of children who had been brought up in a minority religious community, Re G applies a principle of maximising educational opportunity in order to uphold the mother's proposed educational choice and way of life. This note argues that Re G was wrong to do so, should not be regarded as establishing any new principle and that the only relevant principle, both in determining this case and future cases, ought to rest on the psychological well‐being of the child.     

浅析司法机关在社区矫正工作中的问题与对策——以四平市社区矫正工作为视角

社区矫正制度是我国司法改革的重要内容。目前。司法机关作为社区矫正工作的主体在实践中暴露出了诸多问题。本文以四平市为视角。对司法机关在实施社区矫正工作中面临的问题进行了分析并提出相关对策,以期对我国社区矫正制度的发展有所裨益。     

香港社区警务制度及其影响探究

社区警务是20世纪末在国际范围内兴起的一种适应市场经济体制的警务模式,这种模式已经成为国际警务发展的大趋势。作为原英国殖民地,香港的法律制度和警察体制都深受英国警务制度的影响,从而形成了具有香港特色的较为严谨的法律体系和专业警察队伍。20世纪70年代,英国的社区警务制度在香港悄然兴起,并在遏制犯罪和促进警民关系等方面起到积极作用,形成了相对完整、系统的社区警务模式。香港回归以来,内地公安机关逐渐引入香港先进的警务模式和理念,从而对大陆的警务政策的制定和警民关系的维护产生了巨大的影响。
