创新:全球化条件下中国社会主义的抉择

全球化条件下的中国,走向市场经济的背后是一种全新的革新机制。这种机制在中国过去任何的制度记忆和体验中都是前所未有的,建立这种机制的压力和经验几乎全都来自外部世界。为了适应这种全球化所导致的由内生型改革走向外生型改革的挑战,中国的社会主义理论和制度层面都进行了创新,但从进展看仍然面临从外部到内部的不平衡问题。为了迎接全球化条件下的经济市场化、政治民主化和思想文化多样化的深刻挑战,当代中国的社会主义必须真正着眼于长远进行理论和制度创新。     

Correlates of Mortality in a U.S. Cohort of Youth, 1980–98: Implications for Social Justice

This paper reports results of a study based on a nationally representative sample of U.S. youth (N = 11,549) that asked two questions: (1) How does family structure affect the likelihood of adolescent death beyond that of race/ethnicity, sex, socioeconomic status, personal behavior, and other structural factors and (2) under what conditions might appeals for social justice be warranted for relative mortality statuses and for absolute gains in mortality? The study found that marital instability increases the likelihood of dying when controlling for a variety of other factors including class, race/ethnicity, sex, and unemployment rate in area of residence. The author argues that this finding lends support to social justice arguments to redistribute resources in such a way as to ensure the likelihood of absolute gains in mortality. The study also found, however, that race/ethnicity/sex also accounted for the likelihood of dying independently of family structure when controlling for socioeconomic and other factors. The author argues that this finding lends support to social justice arguments to redistribute resources on the basis of relative mortality statuses.

本文考察了温室效应理论对缔结《联合国气候变化框架公约》的决定性影响 ,并对《联合国气候变化框架公约》的基本法律原则 (规则 )及其对国际环境立法的贡献进行了述评。     

INTRODUCING PERSPECTIVES IN FAMILY LAW AND SOCIAL SCIENCE RESEARCH

This article provides an editorial introduction to the following three related articles on the growing use and influence of social science research in family law. It first considers why this has become problematic and identifies some common strategies used by advocates, sometimes under the guise of scholarship, to destroy the standing of research findings contrary to their ideological or political position. Then it discusses briefly the remedies proposed to mitigate these kinds of problems within the following three articles.     

按势分配与社会公正：乡镇煤矿背后的利益关系——以湖南塘镇为例

利益分配是考察社会公正与和谐社会建设的一个视角.基于湖南塘镇乡镇煤矿背后的矿主、矿工、村组、基层政府及各相关部门、红黑恶势之间利益关系的考察发现,乡镇煤矿背后存在着按势分配的两端:一端是在井下漆黑世界劳作的外地农民矿工,另一端则是一些握有权杖的腐败官员或依仗暴力的社会混混.这样一种按势分配的利益格局对社会公正形成了强烈的挑战.我国目前收入分配差距过大的原因,主要不在于市场化,而在于制度不健全所导致的腐败和灰色收入.     

马克思主义法律思想中国化研究论纲——写在《现代法学》首任主编黎国智教授80寿辰之际

推动马克思主义的中国化,把握社会主义法治理念,弘扬法治精神,应当认真研究马克思主义法律思想的中国化。在国外,马克思主义法律思想研究已经上升到了一个新台阶;在中国,通过多年马克思主义法律思想研究的铺垫,已经具备了更进一步研究的坚实基础。但是,马克思主义法律思想中国化研究必须有独特的思路、完善的内容设计,并应该考虑到新世纪新阶段马克思主义法律思想中国化面临的新机遇和新挑战。     

社会活力问题研究

考察社会活力一般会涉及三个基本要素,即经济要素、社会制度要素和精神文化要素。社会活力有两个来源:一是根本来源,二是直接来源。社会活力的根本来源源于生产力和生产关系之间关系的合理性。直接来源源于社会制度的先进性、社会运行体制的合理性、社会运行机制的多样性。激发社会活力是社会主义制度的特征之一,充分体现了社会主义制度的根本属性。     

中国律师办案中的关系因素——社会资本理论视角的分析

从社会资本理论视角,对中国律师执业中的关系因素进行调查和分析,为探讨中国律师与中国司法的新视角。在问卷调查的基础上,本文认为,作为重要的社会资本,人际关系在中国律师执业中具有重要的意义,关系在律师办理案件时有便于证据收集和采用、有利沟通、获得信息、方便工作、判决倾斜等作用。
