设区的市环境立法从规范完善和功能提升出发补强了地方环境治理的有效性。基于全面建设生态文明和依法治理的双重目标约束,央地互动在纵向关系、横向关系和动力机制三个维度上为市级环境立法权设定了方向性约束。市级环境立法必须在制度框架、工具选择、执行过程、主体互动、利益整合等方面做出新的制度设计。为此,必须超越中央立法和地方立法之关系的传统限定,以及中央中心主义和地方自主治理的制度分歧,塑造市级环境立法创新的结构秩序,突出底层环境立法的优先性与上溯能力,提升市级立法权的创新能力。  相似文献

机关事务治理制度是国家治理体系的一项重要内容,有机融汇于新中国成立70年来的历史叙事之中。如何理解我国机关事务治理制度的历史变迁,是影响国家治理体系和治理能力现代化的一个重要命题。我国的机关事务治理从以"后勤服务"为主要表现形态的传统机关事务管理向以"运行保障"为主要表现形态的现代机关事务治理转型,经历了雏形渐成、改革发展、深化改革三次重大的制度变迁。基于历史制度主义的分析范式,机关事务治理制度变迁过程中制度背景、政治变量、路径依赖和关键节点的"混合体"模式深刻影响着机关事务治理制度的变迁历程,国家治理范式下的政治、经济、文化、社会因素则是制度变迁的动力所在。展望未来,机关事务治理现代化要正视新时代赋予的新要求,加强制度创新消解路径依赖逆向张力,推进机关事务治理职能法定化,完善多元协同的机关事务治理模式,从而推进新时代机关事务工作高质量发展。  相似文献

本文从哈萨克斯坦的实例出发,考察单个国家利用制度竞争吸引外国投资产生的一系列决策的差异性问题.它主要聚焦于政治偏见和政治生存效果两者之间的矛盾,这恰恰是正规经济制度发展和实施的推动力.哈萨克斯坦的例子展现了这二者相对重要性的转变对国家在争取外国直接投资(FDI)所产生的显著影响.此外,本文还着眼于经济全球化背景下各个层面在制度竞争中的相对重要性.  相似文献

Mexico experienced the twentieth century’s first social revolution, a decade of struggle from which emerged a new political regime – a post-revolutionary authoritarian or single-party state one – with President Lázaro Cárdenas as leader by 1934. This post-revolutionary creation included organized labor and peasants, a strong interventionist state and a hegemonic party. Cárdenas’ U.S. counterpart, President Franklin D. Roosevelt, too, was leading dramatic ‘New Deal’ institutional and political revolution in the 1930s and 1940s that spawned a new order of expanded federal government, a renovated Democratic Party, and new movements and interest groups, notably, labor. Both nations featured the same major actors: the state, political parties, and organized labor. Both presidents calculated that preserving labor alliances was crucial for formation and legitimization of a new political order, for maintaining conditions conducive to private-sector investment and economic growth, and for political and economic crisis management. Labor’s growing role reshuffled corporatist alliances within and between international neighbors. This study places Mexico and the United States in comparative context in the early twentieth century and analyzes elite control and inclusion of organized labor in transformation of political landscapes in two different political regimes – a democratic one couched in an established constitution and a post-revolutionary authoritarian one born of a bloody upheaval.  相似文献

This conceptual paper seeks to advance neo-institutional work that has traditionally portrayed environmental and social protection policies as constraints followed by businesses. Drawing from the policy sciences literature, we propose that in the United States, businesses tend to show increasing resistance as the protective policy process moves from initiation to selection and growing cooperation thereafter. Most importantly, we also contribute to the neo-institutional theory literature by positing that this inverted U-shaped policy process–business response relationship proposed for the U.S. context may be moderated by variations in the level of democracy, system of interest representation, regulatory approach, and national income.

中国城市化发展的直接后果就是大量农用地转化为非农用地,耕地资源日益减少.对此,中央政府加强了土地调控力度,严格保护土地资源.但地方政府有与中央不同的目标,而现有的土地产权制度为地方政府规避中央的调控政策提供了可能性.在梳理现代产权理论的基础上,深入剖析了土地产权的三重分割问题,即土地国有和"全民所有"的分割,所有者与管理者的分割,以及中央政府与地方政府的分割.地方政府实际上获得了管理和经营土地资源的直接权力,而又无需承担相应的长期后果.这一方面激励地方政府超常经营土地的行为,形成所谓"土地财政"现象;另一方面造成土地保护陷入集体行动困境.由于土地管制和市场调节双重失灵,尽管中央政府不断收紧土地闸门和信贷闸门,对土地开发市场的调控效果仍不明显,土地资源的低效率运用未见实质性改观,耕地保护压力仍然很大.  相似文献

中国从计划经济向社会主义市场经济的转型面临着制度变革的“双重挑战”:既要建立起全新的与市场经济相适应的制度体系,又要在有效新制度体系尚未就位的情况下保障基本的治理成效。应对“双重挑战”的一种重要方式是“运动式治理加制度建设的组合拳”:一方面,以制度建设为根基,逐步建立适应市场经济的制度体系,从而完成制度体系的本质性变革;另一方面,在缺乏有效的制度体系的情况下,通过运动式治理应对不断出现的现实问题以保障基本的治理绩效。论文对1978年至2012年土地使用制度变革历史过程的实证研究验证了上述的“双重挑战”以及“组合拳模式”的运作机制与现实成效。“运动式治理加制度建设的组合拳模式”能够缓解短期治理压力从而拥有更大试错空间,进而能够通过持续探索与调整寻求切实可行的解决方案,最终成功完成制度变革。  相似文献

Abstract

From 1989 to 2008, local governments in Germany have experienced ‘massive’ institutional change. Local constitutions have been altered in all German states giving citizens more say in local politics, while at the same time reducing local parties' influence. The paper first describes the changes according to two analytical models of local democracy. It then tries to explain the institutional change as a process of diffusion in a federal state. Three questions are answered in the explanatory part: Why did some forerunner states start with the reforms at the beginning of the 1990s and not earlier? Why did the reforms continue in other states although there was no general pressure from above? And why did some states continue with the reforms while others did not? In the first part of the paper the changes are described quantitatively while a qualitative approach is used in the explanatory part. The analyses show that the beginning of the reforms is related to ‘massive political failure’ while further reforms are a result of rational learning by different actors (large parties, small parties, non-governmental actors) depending on different means of reform. Based on these results we forecast a continuation of the reforms in the next years leading to a convergence of citizen-oriented local government all over Germany.  相似文献

Processes of European integration and growing consumer scrutiny of public services have served to place the spotlight on the traditional French model of public/private interaction in the urban services domain. This article discusses recent debates within France of the institutionalised approach to local public/private partnership, and presents case study evidence from three urban agglomerations of a possible divergence from this approach. Drawing on the work of French academic, Dominique Lorrain, whose historical institutionalist accounts of the French model are perhaps the most comprehensive and best known, the article develops two hypotheses of institutional change, one from the historical institutionalist perspective of institutional stability and persistence, and the other from an explicitly sociological perspective, which emphasises the legitimating benefits of following appropriate rules of conduct. It argues that further studying the French model as an institution offers valuable empirical insight into processes of institutional change and persistence.  相似文献

Institutional design can impact the dynamics of power relations in Central Asian states. Majoritarianism and the rigidity of the fixed terms of presidential systems are amplified by the personalist regimes of Central Asia, often leading to instability. A parliamentary system may reduce the political repression of these regimes by decreasing the stakes in each particular election. It may also increase stability due to the higher flexibility of the system. The effectiveness of the parliamentary system, however, depends largely on the existence of strong cohesive parties.  相似文献
