中法全面伙伴关系框架下的政治与经济

1997年中法建立全面伙伴关系以来,两国关系有了很大进展,政治关系良好,合作领域增加,经贸、投资和文化交流同步增长。但中法政治关系与经贸水平不相适应的状况没有得到根本改变,政治关系优势没有发挥出来。中法关系的前景取决于国际政治大背景、两国国内政治状况、双方经济竞争力和怎样处理分歧四个变量。     

论设立中公司的法律地位

设立中公司是一个逐渐被学术界认可的概念 ,设立中公司的概念对于股份有限公司较具意义 ,本文通过探讨设立中公司的法律地位及其法律性质 ,以期有效解决设立中公司实践中遇到的问题。设立中公司的起算时间和法律地位都存有争议。设立中公司理论的建立对于解决我国实践尤其是国有企业改革中出现的问题甚有启示。     

关于马克思劳动价值论百年争论的思考

劳动价值论在整个马克思主义理论体系中占有重要地位，是马克思主义政治经济学的逻辑起点和科学社会主义的理论支柱，马克思的劳动价值论适用于一切社会的商品生产。百年的争论表明：马克思的劳动价值论具有强大的生命力，无论是“多余论”，还是“要素价值论”，都反驳不了马克思劳动价值论的科学性。在建立社会主义市场经济的过程中，我们要结合新情况深化对劳动价值论的认识，推动社会主义市场经济的发展。     

对峙与和解——性别诗学视野下的两性关系

性别维度是人存在的一个重要维度,性别诗学探讨的是性别因素在社会现象中的种种表现,这包括女性主义对男性压迫女性历史的梳理.性别诗学又是超越女性主义的,它更关注两性的和谐相处,暗示两性间要走向对话、达成伙伴关系的趋势.尽管伙伴关系具有强烈的乌托帮性质,但性别诗学指向的却是对理性逻各斯的否定以及对诗意艺术精神的追求.     

Partnership in Love and in Business

This article ponders the influences ofthe dichotomous nature of our understanding law andto questions that starting point on different levels oflegal thinking.The purpose of law is to make rules for our socialbehaviour but there are no specific images of humanbeings behind law. When there are no defined images,subconscious cultural images shape our thinkingsometimes even without our realizing it, and withoutserious discussion. The division between family andthe market has to do with gender divisions as well aswith the division between family and contract law. Thelogic and human image behind these two branches of lawis different.Even if we may behave differently in differentsituations we do not become altogether differentkinds of human beings with different values when wechange surroundings. Thus, we might instead develop asa starting point human co-operation law where familyand business partnerships are seen as specialbranches. The starting point of this co-operation lawwould be many-sided and pluralistic human beings, who would be atthe same time loving and egotistic, communal andindividual, feminine and masculine. Such human beingsmay be regarded as multicoloured instead of white orblack.     

国际形势及中法关系

中国在21世纪的经济、文化重要性已得到世界公认。当前,法中关系发展良好,双方在全面战略伙伴关系的框架下不断推进经济、文化、科技的交流与合作,超越单一的经济思维,建立了文化互信。欧洲一体化进程不会停滞。欧洲各国要向公众解释政府的意图,使公众理解合作带来的是经济发展,而非本国文化特性的丧失。     

The undoing of a unique relationship? Peace and security in the EU–South Africa Strategic Partnership

ABSTRACT

When the European Union (EU) and South Africa acceded to a strategic partnership, they expanded into new areas of partnership. One of these areas was peace and security, which is the focus of this article. The article argues that, although there appears to be a shared understanding of what security means, the strategic partnership has not been utilised significantly to further this understanding in practice. This is largely due to the EU's preferences for a continental, multilateral approach over the bilateralism of a strategic partnership. At the same time, South Africa sees its strategic partnership with the EU as being outside of its broader commitment to regional security. As a result the peace and security element of the strategic partnership has not been leveraged effectively despite several entry points for action. The article thus concludes that both the EU and South Africa need to re-think the current arrangement.     

The Impact of the European Union on Sub-National Mobilization in A Unitary State: The Case of Estonia

The discussion of multi-level governance and sub-national mobilization has become a critical case for those concerned with the political and institutional consequences of European integration. The evidence so far indicates that the EU impact on the empowerment of the sub-national level has not been as uniform within member states as the multi-level governance concept traditionally would assume. This article explores the Europeanization impact on sub-national mobilization in Estonia. The results of the study address the factors affecting the emergence of multi-level governance and provide a foundation for the analysis of the possible wider applicability of these manifestations to a wider set of countries with similar territorial and political structures.     

对增强中国-东盟政治互信的思考——写在中国一东盟建立战略伙伴关系10周年之际

本文回顾了中国-东盟战略伙伴关系建立10年来的经历，认为政治互信是连接双方关系的重要纽带。10年来，双方在政治互信的建设方面取得了不少实质性的成果，但也存在着不足。本文指出，未来10年深化中国-东盟战略伙伴关系的关键仍取决于政治互信的建设，双方都应为此而付出不懈的努力。     

公用事业公私合作制实施的问题与对策——以“汇津污水处理案”为实证分析对象

多年来,公用事业公私合作制的实施加快了我国公用基础设施建设的步伐,增加了公共产品的数量,提高了公共服务的质量与效率。然而,在公私合作制实施过程中还存在着对私人资本保障不足、对公共利益关注不够等问题,尤其是在污水、垃圾处理等新兴环保型公用事业领域存在的问题较为突出。本文认为,可以通过完善政府相关职能、健全收费机制、建立公私合作合同制度、完善公众参与机制等途径,促进公用事业公私合作,提高公用事业产品与服务的质量,以期更好地实现社会福祉。
