Capacity assessments are performed when there is suspicion that a person is unable to adequately care for their physical, medical, or financial well-being. The purpose of these assessments is to inform the legal system as to whether or not guardianship may be necessary. It is well established that certain mental illnesses, such as neurocognitive disorders (dementia) or psychotic disorders (like schizophrenia), may diminish capacity and, in some cases, lead to the need for establishment of a legal guardian. However, personality disorders are another common category of mental illness which may impair decision-making. There is very little information in the literature about how or why these disorders could impair capacity, and thus, it can often be difficult to discern whether clients with personality disorders are substantially unable to care for themselves—versus unwilling to act in a way contrary to their ingrained habits. We present a series of three cases in which clients are determined to lack capacity primarily mediated by a personality disorder diagnosis. They are demonstrated to have mild deficits in cognitive functioning, but they show impaired decision-making out of proportion to these deficits. In all three cases, it is apparent that the personality disorder is substantially impairing their ability to care for themselves. Discussion includes consideration for ways to incorporate evaluations of cognitive function, activities of daily living, and personality considerations into capacity assessments, and how to approach recommendations (such as guardianship vs. less restrictive option) based on both level and scope of impairment.  相似文献

How do non-partisan advisors in Ministers’ offices maintain political neutrality while immersed in a highly politicised environment? Private Secretaries are ubiquitous non-partisan public service representatives in the political environment of Ministers’ offices. There has been significant research undertaken the role of political advisors in Ministers’ offices, yet the contribution of these non-partisan advisors has not yet been described in academic literature. The risk of Private Secretaries being overly responsive to politicians and undertaking political tasks rather than maintaining neutrality is ever present. Further, they must actively manage the risk of free and frank advice being obstructed by political advisors. This article presents views about political neutrality gleaned from interviews with Private Secretaries who have worked in Ministers’ offices in New Zealand during the period of 1997–2018. It presents new insights into the tensions within a key setting of the core executive.  相似文献

This article discusses the origins of the Efficiency Unit's ‘Next Steps’ Report, published 20 years ago which recommended the executive agency as an organisation for much of the British government. Within five years more than half the civil service had been transferred to work in agencies but the other major recommendation of the report – improving the management skills of the senior civil service received far less enthusiastic attention. From the Fulton Report, the Next Steps report to the Capability Reviews of current Whitehall the same problem is highlighted: there is still too little management competence within the public service despite the endorsement of the need for improvement by successive governments.  相似文献

In the United States, the Safe Drinking Water Act (SDWA) regulates most groundwater used for drinking water. The Act covers most urban areas but because it does not cover small water systems, it implicitly exempts nearly half of those living in rural America. In large measure, monitoring required by the SDWA has illustrated the prevalence of naturally occurring arsenic in groundwater in concentrated areas throughout the country. Even though many in Congress seem aware of this threat and have, indeed, supported more stringent arsenic standards, Congress, on the whole, has failed to update the SDWA to cover those water systems left unprotected by the Act. Conventional political science theory suggests that effective congressional oversight depends on Congress creating both active (e.g., hearings and commissioned studies) and passive oversight mechanisms (i.e., citizen suits and opportunities for constituent feedback). In this case, Congress had, in fact, created sufficient tools to detect a serious problem but, having identified it, nevertheless failed to respond. Why? In exploring Congress’s inaction, we find something unexpected: the structure of the SDWA has created perverse incentives not only for unregulated water systems but also for regulated systems to push to keep exempted water systems unregulated. The outcome is that those outside of the SDWA’s protections remain outside and continue to drink contaminated water by the glass full. So, while Congress created a loophole, it may have inadvertently tied a noose.  相似文献

The article focuses on the relationship between the executive and the judiciary in respect of a legal case that provoked public outrage. This outrage entered into the media spectacle and was channelled by the executive into calling a royal commission. The royal commission was charged with re‐examining the police actions and the legal case. However, hidden behind its narrow terms of reference was the larger question of justice being ‘blind’ to a network of privilege. As such, the royal commission had the potential to threaten the independence of the judiciary.  相似文献

Most intra‐ and interorganizational decision making entails negotiations, and even naturally talented negotiators can improve with training. Executive trainings for managers and leadership programs for publicly elected officials, public managers, and nongovernmental organizations frequently include negotiation modules. These efforts, however, have yet to reach community leaders who also need to develop their negotiation skills. We propose that members of disadvantaged low‐income communities who lack educational and economic opportunities, and are less able to advocate for their own interest, need to build and strengthen their civic capacity, including their negotiation skills, to become more effective parties to decisions affecting them. While many professionals and executives have access to training, such opportunities are less accessible to the leaders of these disadvantaged communities. Although such leaders draw from their own heuristic knowledge, skills, and abilities, they could also benefit from sharpening their negotiation skills. We propose that the multidimensional understanding of their community that members accumulate through direct experience is indispensable, nontransferable to outsiders, and not teachable through in‐class activities. Leaders with the ability to leverage knowledge and assets to connect effectively to community insiders as well as to outside people, institutions, and resources, however, possess some specific inherent personality traits as well an understanding of social structures, strategies, and agency, which can be taught and learned. Such skills as how to conduct negotiations around the table and away from it and how to identify community members who can help and how to rally them are also teachable. The cases were chosen to illustrate the knowledge, skills, and abilities (KSAs) that make these leaders effective in and beyond their communities. We highlight those KSAs that we think are teachable in the framework of a negotiation module in community leadership training to enhance civic capacity for community betterment.  相似文献

在我国行政法的立法文件中,行政法规范的术语与行政权的范围是非常密切的,即行政法规范的术语对行政权的范围具有决定意义,一个合理的术语既可以使行政权的范围相对明确,又可以使行政权的行使比较规范,反之,一个不大合理的规范表述则既可以使行政权的范围变得非常模糊,又使行政机关行使权力无规则可循。对于行政法规范术语如此重要的意义我国行政法学界并没有给予高度关注,到目前为止还没有一个完整行政法规范术语的著作,而2000年通过的《中华人民共和国立法法》也似乎将这一问题遗漏了。因此,我们从目前行政法规范术语存在的问题、行政法术语表达与行政主体的关系、行政法规范术语的不规则与行政职权的不确定关系分析、完善行政法规范术语与确定行政权范围的对策等方面作了较为系统的探讨。  相似文献

经营者因利益冲突而寻租,经营者自定薪酬大行其道,致使年薪制在实践中背离其设计目标.程序公正成为控制经营者自定薪酬的关键,这就要求提高经营者薪酬透明度;通过排除"灰色董事"和引入商事判断规则,超越董事会潜规则,增强利益冲突隔离机制的有效性;股东大会的事前控制应定位于薪酬政策和长期激励方案,并通过引入股东提案权和代表诉讼机制,强化股东对经营者薪酬的事后监督.  相似文献
