随着世界经济全球化的发展和我国加入WTO ,外商投资企业在我国经济结构和经济发展中的作用越来越重要。外商投资企业的出现 ,使我国原有的经济结构发生了很大变化 ,也使原有的劳动关系发生了很大变化 ,使外商投资企业在立法和劳动关系上呈现出一系列鲜明特征。     

县域社会经济发展与府际关系的调整——以金华—义乌府际关系为个案研究

县域社会经济的迅猛发展带来传统府际关系的矛盾冲突,从经济关系、行政关系和治理关系这一三维分析框架剖析这一矛盾冲突,能有效解释地方府际关系变迁与发展的逻辑。金华—义乌府际关系的典型案例可以得出三个结论:(1)合理的经济关系必须符合市场经济规律的客观要求,它不仅仅是单向的辐射关系,而且更是双向的对流关系。(2)科学的行政关系必须回应权力运行的规则,它不是单一的行政管辖,而是双方的权力互动。(3)和谐的治理关系必须基于社会发展的规律,它不是单边的各自为政,而是双边的利益共生。惟其如此,地方府际关系才能从根本上实现长效的制度安排,并为地方政治文明、物质文明和精神文明的发展提供永续的制度支持。     

Weniger Koordination,mehr Markt? Kollektive Arbeitsbeziehungen und Neokorporatismus in der Schweiz seit 1990

Dieser Beitrag diskutiert die These, wonach sich die industriellen Beziehungen in der Schweiz weg vom koordinierten rheinischen hin zum marktorientierten angelsächsischen Modell bewegten. Die Koordination zwischen Arbeitgeberverbänden und Gewerkschaften wird erstens im Bereich der kollektiven Arbeitsbeziehungen sowie zweitens in der Politikgestaltung untersucht. In einem dritten Schritt wird die Entwicklung der Repräsentationsmacht der Verbände seit Anfang der 1990er Jahre diskutiert. Nur wenig spricht dafür, dass sich die Schweiz vom Koordinationsmodell bewegt: Dezentralisierung und Individualisierung der Lohnpolitik haben zwar zu weniger Koordination geführt. Im Rahmen der Personenfreizügigkeit haben Gesamtarbeitsverträge jedoch stark an Bedeutung gewonnen. Die Verbände sind zudem weiterhin in den meisten ausserparlamentarischen Regulierungsinstanzen vertreten und spielen in der Wirtschaftspolitik die Rolle des Vetoplayer.     

国际关系学科中美国的知识霸权

美国国际关系研究在国际关系学科中是否处于知识霸权地位,是国际关系学者关注的主题之一。本文试图比较欧美学术期刊以探讨此问题,即《国际研究季刊》、《国际组织》、《欧洲国际关系》、《国际研究评论》。本文选取上述四份权威期刊在1997年-2006年期间所刊发的论文为分析文本,侧重分析论文作者的国籍、研究主题及研究方法,进而探讨美国国际关系研究在学科中地位的变化问题。进而尝试从不同角度探讨如何改变美国知识霸权的路径,包括对美国国际关系研究的优点及缺失的充分认识、国际关系学科史的重述等问题。     

“劳动力派遣”制度法律探析——兼论《劳动合同法（草案）》中“劳动力派遣”相关立法条文

通过劳动力派遣形成的法律关系是一种复合的架构,其中包括:派遣单位与用工单位之间形成的一般的商事合同关系,劳动者与派遣单位、用工单位双方之间形成的特殊劳动关系,并以后者为核心。在特殊劳动关系中,应该区分不同的方面,在派遣单位与用工单位之间合理地划分劳动基准法中所规定的一般雇主责任。《劳动合同法(草案)》中“劳动力派遣”的相关条文有待进一步完善。     

刑事法中法条竞合

法条竞合表面上符合数个犯罪构成，但最终适用的只是单一规范，其他规范在评价及适用上均被排除，这种现象体现在规范上的关系就是：法条竞合既有犯罪构成的逻辑关系，也有犯罪构成的评价关系。法条竞合以具体犯罪行为为前提，因此属于罪数形态论范畴，是本来的一罪。法条竞合有特别关系和补充关系两种类型，其适用的法律原则是特别法优于普通法。     

Does border enforcement deter unauthorized immigration? The case of Mexican migration to the United States of America

This paper asks whether the migration decisions of unauthorized Mexican immigrants to the USA have been influenced by stronger US border enforcement efforts since 1993 that have sharply increased the physical risk and financial cost of illegal immigration. These measures were supposed to have decreased the probability of successful entry, thereby lowering the expected benefits of migration. We carried out a logistic regression analysis of data from a recent survey of 603 returned migrants and potential first‐time migrants in rural Mexico. Our findings indicate that tougher border controls have had remarkably little influence on the propensity to migrate illegally to the USA. Political restrictions on immigration are far outweighed by economic and family‐related incentives to migrate. An alternative, labor‐market approach to immigration control with higher probability of effectiveness is outlined.

从劳资关系运行参与者、劳资关系运行规则角度分析，浙江模式劳资关系由以下要素构成：“本土化”的资方；“商业化”原子状的劳方；少（适度）介入、“无为而治”的政府；“自然生成的”劳资关系运行规则；企业一体化的劳资关系；以效率为核心的劳资关系运行。浙江模式劳资关系运行的特点是在以上要素基础上，形成了“自行协调、合作，走向两利、共赢”的运行体制。     

Deconstructing the myth of the Tatar Yoke

Analysing and comparing the various conventional and revisionist narratives on what is known as the ‘Tatar Yoke’, this article aims to show that Western historiography has long been critical of the dominant negative view on the Tatar–Mongol rule over Russian principalities and that in Russia we find similar revisions in history – with some exceptions – only in post-Soviet times. This article aims to demonstrate how the revisionist views on the Tatar–Mongol rule contributed to the political and cultural transformation of contemporary Russia. In the part which analyses the revisionist discourse in Russia the emphasis lies on the new Tatar narrative. For Tatars the new interpretation of the Tatar–Mongol rule is of outstanding importance because it functions as a means to enhance Tatar national pride, and it contributes to Tatarstan's sovereignty project.
