论意思表示错误中的“性质错误”

私法自治强调的是当事人以自己的意思发生私法上的权利和义务关系，所以法律行为就是实现私法自治的最佳手段。作为法律行为核心要素的意思表示的完整、无瑕疵，便成为私法自治的重要因素。但是，法律如何在意思自治和交易安全的矛盾中做出价值判断和选择，就显得尤为重要。性质错误作为一种特殊的动机错误，在法律的价值判断中起着至关重要的作用．     

High-quality Planning for Economic Development in China's 14th Five-Year Plan under the Strategic Orientation of Modernization

High-quality planning for the 14th Five-Year Plan has a bearing on China's future modernization and medium and long-term development. The key themes of the 14th Five-Year Plan oriented to the modernization strategy should take realizing the people's satisfaction of their needs for a better life as the strategic goal; the establishment of a modern economic system as the core content; the supply-side structural reform as the main line; the cultivation of new driving forces for economic development as the cheif measure; and a high standard market economy as the institutional guarantee. The key areas of the 14th Five-Year Plan are the modernization of the industrial sector, modernization of the innovation sector, integration of industrialization and informalization, and modernization of regional development. The 14th Five-Year Plan should take high quality development as its policy orientation; and make greater strides in the high quality development of the macro-economy, meso-economy, micro-economy; the opening up to the outside world; the modernization of industrial chains and modernization of infrastructure during the 14th Five-Year Plan period.     

论传统文化与人民警察的人文素质

提高人民警察的人文素质,就是要使人民警察养成按照人的发展规律及其特性达成"做人"目的的心理品质。学习传统文化是提高人民警察人文素质的有效途径。传统文化中"自强不息"的进取精神、"道尊于势"的从道精神、"贵和尚中"的和谐精神是可以内化为人民警察人文素质的最主要的人文精神。     

Stewardship of quality of care in health systems: Core functions,common pitfalls,and potential solutions

National Ministries of Health in low‐ and middle‐income countries (LMICs) have a key role to play as stewards of the quality agenda in their health systems. This paper uses a previously developed six‐point framework for stewardship (strategy formulation, intersectoral collaboration, governance and accountability, health system design, policy and regulation, and intelligence generation) and identifies specific examples of activities in LMICs in each of these domains, pitfalls to avoid, and possible solutions to these pitfalls. Many LMICs now have quality strategies with clear vision statements. There are good examples of quality agencies and donor collaboration councils to coordinate activities across different sectors. There are multiple options for accountability, including public reporting, community accountability structures, results‐based payment, accreditation, and inspection. To improve health system design, available tools include decision support tools, task‐shifting models, supply chain management, and programs to train quality improvement staff. Policy options include legislation on disclosure of adverse events, and regulations to ensure skills of health care providers. Lastly, health information tools include patient registries, facility surveys, hospital discharge abstracts, standardized population and patient surveys, and dedicated agencies for reporting on quality. Policy‐makers can use this article to identify options for driving the quality agenda and address anticipated implementation barriers.

《产品质量法》中的民事责任包括侵权责任,违约责任及二责任的竞合三种情形。产品致害引起的财产损害依侵权或违约进行诉讼皆可,对于人身伤害依侵权进行,对于产品本身的损害依违约进行。若三项损害在一个损害行为中都存在时,应作为一个诉处理,只是运用的法律依据不同。
