论被继承人宽宥制度的适用

被继承人宽宥制度,是指当继承人因特定原因丧失继承权后确有悔过行为,经被继承人宽恕后重新恢复继承权的一项民事法律制度,在我国具有一定的社会基础和深厚的历史渊源。设立被继承人宽宥制度,旨在为有过错的继承人提供改过自新、重新获得继承权的机会。     

Less Safe in the Ivory Tower: Campus Sexual Assault Policy in the Trump Administration

ABSTRACT

Since the late 20th century, the federal government has regulated colleges’ and universities’ handling of campus sexual and gender-based violence (CSGBV). Although the arc of history has bent toward establishing greater protections for victims of such violence, new proposed regulation by the U.S. Department of Education under the Trump administration focuses more heavily on ensuring due process rights for students accused of CSGBV. Most recently, in November 2018, U.S. Secretary of Education, Betsy DeVos submitted a proposed rule change to the regulation of Title IX of the Education Amendments of 1972. This article provides the historical context for this most recent proposed federal regulation of CSGBV and discusses the criticism of this proposal that, if it is implemented, students would become less safe in the ivory tower.     

Forensic Application of Analytical Mechanics in Fatal Fall From a Height

Fatal fall from a height initiated with a swinging motion on the sagittal plane of the victim's body is examined. Method of analytical mechanics is adopted to establish the functional relations between the swinging angle of the body and the force needed to sustain the body until release, and the amount of the horizontal displacement that would occur after release. The analysis is applied to support an expert opinion presented in a criminal court in which two accused were convicted of murder for dropping a female victim from a bridge. The results indicate that it is unlikely for the body to locate as recorded by the police investigation report in the case. This study demonstrates that a straightforward mechanical analysis can be utilized to examine uncommon falling scenarios.

自我与职业的双重生产:基于网络主播的数字化表演劳动实践

伴随电商直播时代的到来,青年带货主播的劳动激励机制从"礼物打赏"转变为"带货提成",其工作形态也从情感劳动转向数字化表演劳动。数字化表演劳动是指主播通过"养号"、组团、打造"人设"、激活消费者体验等方式,创造出一种区别于线下的购物剧场,从而将粉丝的观看量转化为消费者的订单量。由于主客观方面的限制,基于数字化表演劳动的直播带货会形成不稳定的短期化就业。但"离场"后的主播并不完全切断与直播的联系,而是将数字化表演劳动后置为一种能随时"返场"的就业选择,以此更主动、更具弹性地应对不确定的未来生活。在此背景下,我们需要创造精准服务各类青年数字劳动者的良好制度环境,促使其成为壮大数字产业的生力军和推进数字治理的新力量。     

South Korea's Faustian Attitude: The Republic of Korea's Decision to Send Troops to Iraq Revisited

South Korea sent troops to Iraq not because of any perceived threat from an Iraqi nuclear programme, but to seek influence over American foreign policy towards North Korea. At no point did the general public support the American invasion and war in Iraq; most South Koreans also opposed sending troops to Iraq. However, the government chose to send first non-combat and later combat troops to Iraq, and the public approved of the former choice and support was growing for the latter. The liberal President Roh Moo-Hyun had to persuade the public on this issue, even in opposition to his core supporters, risking political isolation. What the public and the President aimed at was a peaceful resolution of the North Korean nuclear issue and business opportunities. The national interest that South Korea pursued in sending troops to Iraq was policy influence over the US guarantee not to use military power against North Korea.

福柯的系谱学对权力／知识的分析对人-社会科学的研究范式与书写方式产生了深刻影响。教育学实践领域也受其冲击而发生了话语的转换。如果我们从系谱学的角度来反思教育学寻求学科化的历史进程，就会扩大对学科这一概念的理解：作为权力／知识实践方式的学科制度不仅是科学化的标志，也是控制现代生活的策略与技术。因此，对作为一门学科形式存在的教育学知识的寻求未必是适当的或必要的。目前，我们似乎更应该走进学校日常生活，由此迈向具体的教育实践。这或许是教育学走出迷茫之路的一条可能的途径。
