法医学尸体检验职业防护指南(建议稿)

法医工作者的职业暴露风险极大,案件现场及尸体上的有毒有害物质、高致病性微生物以及利器、骨折等因素均可能给法医带来身心伤害甚至生命危险。随着经济社会发展,法医的工作环境已经较过去显著改善,但是针对个人防护的重视程度仍需提高。近年来公共卫生事件频发,给法医职业防护带来新的挑战,迫切需要借鉴生物安全领域的先进技术和防护理念,以满足新形势下法医工作的需要。本指南立足当前法医职业防护的实际需求,从暴露风险、防护分级、应急处置等角度阐述,希望能为制定法医职业防护相关标准提供参考,以指导法医工作者开展个人防护工作,为提升法医职业化水平和身心健康提供帮助。     

Presumptions,Burdens, and Best Interests in Relocation Law

The pure “best interests” approach to relocation law is a failure. It is unpredictable and expensive, increasing conflict and discouraging settlement. The “fundamental questions” proposed by Parkinson and Cashmore in their article will not reform the law. Real reform will require the use of presumptions or burdens to guide best interests. “Presumptions” are not “rules,” but only starting points. No simple presumption “for” or “against” all relocations can be justified, but there are large categories of cases that do warrant presumptions: interim moves, unilateral relocations, shared care, and predominant primary caregivers. The first three involve presumptions against relocation, while the last—the largest category—warrants a presumption that relocation is in the best interests of the child, unless the contrary is proved. There will remain a small minority of in‐between cases where none of these presumptions will operate, recognizing the limits of our general knowledge. It is time to move the relocation reform debate beyond pure “best interests,” to the next stage, to a serious discussion of which cases warrant presumptions, and of what strength.

我国有些地方法院进行了量刑规范化的一些尝试。为扭转我国"重定罪,轻量刑"的观念,减少"人情案"、"关系案"的作用空间,使量刑日益规范化、专业化,结合美国《量刑指南》从无到有、从强制性适用到只需参考、咨询的经验,我国应制定全国统一适用的量刑细则,并对量刑方法、量刑程序进行改革。     

New AFCC Guidelines for Parenting Coordination (2019)

In 2017, AFCC President Annette Burns (2017–18) commissioned a Task Force, led by Dr. Debra Carter, to review the many changes and developments in parenting coordination that had occurred across the United States, in Canada, and across the world in the approximately 12 years since the 2005 Parenting Coordination Guidelines were released. Though primarily commissioned to update and revise the 2005 Guidelines, the Task Force also identified emerging issues in need of exploration – the use of technology in parenting coordination, parenting coordination as an intervention when intimate partner violence is a component of the dynamic, the importance of multicultural awareness and responsiveness, and the overall impact of the statutes, rules, and regulations that had evolved in significantly varying forms since parenting coordination first presented as an intervention for court‐involved families. The work of the Task Force, including the new (2019) Guidelines for Parenting Coordination, is presented.     

维护失业女工的生育保险权益——各省市《失业保险条例》和《生育保险条例》研究

目前中国只有部分省市在其《失业保险条例》或《生育保险条例》中明确保证了失业女工的生育保险权益,大多数省市还不能明确保证,不利于维护失业女工的生育保险权益。国家颁布的《失业保险条例》或《生育保险条例》应该确保失业女工享受生育保险,各地在制定出台相关规定时,也应该主动关照失业女工的生育保险权益。     

Tax Disputes under Institutional Instability: Theory and Implications

This article aims to offer the first structural analysis of tax disputes under institutional instability using a core element of the international tax regime as an example. It offers a theory grounded on Mancur Olson's seminal contribution to group dynamics, the logic of collective action. It also suggests implications of this theory that might help to address key enforcement issues faced by the international tax regime in a frequent context worldwide: institutionally unstable countries.
