对规范和完善我国刑事侦查制度的思考

侦审合一体制改革以后 ,我国侦查模式运作经历了“磨合期”和“阵痛期” ,引起了世人注目 ,但也存在着诸多不适应。为规范和完善我国的刑事侦查制度 ,就要实行刑事侦查人员资格制改革 ,修改和完善刑事侦查法律 ,重新设置侦查机构 ,引进侦查手段和实现刑事侦查思想革命。     

刑事侦查中的隐私权保护

刑事侦查是刑事诉讼的重要阶段,担负着发现犯罪事实和犯罪证据的重要使命,但同时也容易对公民的隐私权造成侵害。我国受社会传统的影响,在隐私权保护方面较为保守。从刑事侦查与隐私权的关系出发,分析国内外刑事侦查中隐私权的保护问题,厘清刑事侦查中各价值的均衡问题,反思我国刑事侦查中隐私权的保护。     

律师法修改与侦查工作思路的调整

在律师法修改加强辩护律师的诉讼权利的同时,侦查机关应借力反思过去的工作样态,变被动为主动,自觉地更新刑事侦查理念,调整刑事侦查义务,转变刑事侦查模式,完善刑事侦查机制,提高刑事侦查能力和扩大刑事侦查效果,全面提升各项侦查工作.     

论我国侦查权的性质

刑事侦查权的定位,直接关系到我国刑事侦查程序改革与发展的方向,关系到刑事诉讼惩罚犯罪与保障人权两大价值目标能否实现。我国学术界有不少学者将侦查权定位为行政权。但是,这样一种定位对于我国刑事司法体制改革目标的实现,确保刑事侦查活动的独立性存在着巨大的隐患。因此,必须要将侦查权定位为司法权,以司法的精神和理念重构我国的刑事侦查程序体制,从而确保我国刑事侦查程序改革的成功。     

论信息社会环境下的刑事侦查工作

刑事侦查执法队伍庞大、执法工作范围广泛,需要有强有力的执法监督制度加以约束。健全及加强刑事侦查执法的内部监督机制,成为了亟待解决的课题。文章围绕公安机关刑事侦查执法的内部监督问题进行研究,阐明了我国刑事侦查执法内部监督的必要性,分析了其运行现状及存在缺陷,并就日常监督发现的问题有针对性地提出了解决办法,以期为公安机关刑事侦查执法内部监督工作提供必要的理论依据。

公安机关具体行政行为之认定

根据法律规定，我国公安机关在刑事侦查中具有刑事侦查权，在行政管理中具有行政管理权。公安机关行使这些权力时分别表现为刑事侦查行为和具体行政行为，在司法实践中，这两种行为往往因为种种原因而混同。如果人民法院把名称相同而实质上的具体行政行为当成刑事侦查行为，则导致行政诉讼的不能，不但公安机关的行政行为得不到司法审查，而且，相对人的合法权益也将失去司法救济。如果人民法院把实质上的刑事侦查行为认定为具体行政行为进行诉讼，则势必妨碍公安机关的刑事侦查权，甚至放纵犯罪。因此，准确区分公安机关的刑事侦查行为和具…
