The aim of the current study is to assess whether criminal networks can help young offenders avoid contacts with the criminal justice system. We examine the association between criminal network and cost avoidance specifically for the crime of cannabis cultivation in a rural region in Quebec, Canada. A self‐report delinquency survey, administered to the region's quasi‐population of high‐school students (N = 1,166), revealed that a total of 175 adolescents had participated in the cannabis cultivation industry (a 15% lifetime prevalence rate). Forty‐seven respondents (27%), including 29 who were arrested, reported having participated in a cultivation site that was detected by the police. Results indicate that “who you know” matters in the cultivation industry, and is an important independent predictor of arrest: very few young growers who were embedded in adult networks were apprehended. Conversely, embeddedness in a youth network emerged as an independent risk factor, especially embeddedness in larger networks.  相似文献

Criminal background checks are increasingly being incorporated into hiring decisions by employers. Although originally uncompromising—almost anyone with a criminal record could be denied employment—court rulings and policy changes have forced criminal background checks to become more nuanced. One motivation for allowing more individuals with criminal records to work is to decrease recidivism and encourage desistance. In this article, we estimate the causal impact of receiving a clearance to work on subsequent arrests for individuals with criminal records who have been provisionally hired to work in certain nonlicensed health‐care jobs in New York State (N = 6,648). We employ an instrumental variable approach based on a substantive understanding of the state‐mandated criminal background check process. We examine age‐graded effects within this group of motivated individuals and differential effects by sex in the rapidly growing health‐care industry, which is typically dominated by women. Our estimated local average treatment effect indicates a 2.2‐percentage‐point decrease in the likelihood of a subsequent arrest in 1 year and a 4.2‐percentage‐point decrease over 3 years. We find meaningful variations by sex; men are 8.4 percentage points less likely to be arrested over the 3‐year period when cleared compared with a 2.4‐percentage‐point (and nonsignificant) effect for women. We use the National Crime Victimization Survey to examine whether domestic violence is less likely to be repeated if it is reported to the police and if the offender is arrested. Our longitudinal analyses suggest that reporting has a fairly strong deterrent effect, whereas the effect of arrest is small and statistically insignificant. We find no support for the hypothesis that offenders retaliate when victims (rather than third parties) call the police or when victims sign complaints. We also find no evidence that the effects of reporting or arrest depend on the seriousness of the offense, a history of violence by the offender or sociodemographic characteristics. Our results suggest that the best policies for deterrence will be those that encourage victims and third parties to report violence by intimate partners to the police.  相似文献

Many respondents to opinion surveys say that the citizen's race influences how police officers treat the public, yet recent expert social‐science panels have declared that research findings are too contradictory to form a conclusion on whether American police are biased against racial minorities. We perform a meta‐analysis of quantitative research that estimates the effect of race on the police decision to arrest. Screening nearly 4,500 potential sources, we analyze the results based on 27 independent data sets that generated 40 research reports (both published and unpublished) that permitted an estimate of the effect size of the suspect's race on the probability of arrest. The meta‐analysis shows with strong consistency that minority suspects are more likely to be arrested than White suspects. Depending on the method of estimation, the effect size of race varied between 1.32 and 1.52. Converting the race effect size to probabilities shows that compared with the average probability in these studies of a White being arrested (.20), the average probability for a non‐White was calculated at .26. The significant race effect persists when taking into account the studies’ variations in research methods and the nature of explanatory models used in the studies. Sexual assault prevention and response remains a high priority for U.S. higher education institutions. Indeed, federal legislation and a recent White House task force have reiterated the importance of protecting college students from victimization during their tenure in postsecondary education. Informed by Eisenberg, Lechner, Frerich, Lust, and Garcia's (2012) content analysis, the current study uses a modified College Resources and Sexual Health (CRaSH) inventory to examine the status of 74 Uniform Crime Reports–reporting higher education institutions in Texas. Doing so assesses prevention, resources, response, and aftercare for victims of sexual assault. Findings demonstrate a primary reliance on target-hardening strategies, health clinics, and law enforcement responses, often to the neglect of advocacy, crisis intervention, and educational programs. Directions for research are discussed, and best practices in programming implementation to augment existing strategies are suggested.  相似文献

Public education is a sphere of society in which distributive justice with respect to the allocation of opportunities to learn can have profound and lasting effects on students’ educational outcomes. We frame our study in the distributive justice literature, and define just outcomes specifically from a meritocratic and strict egalitarian perspectives in order to investigate how assignment to academic tracks and the availability of opportunities to learn during high school are associated with students’ academic achievement during college. We examine the role of “just” placement into high school academic tracks, “just” access to high-quality teachers, and “just” assignment of secondary schools’ resources in high school, in relation to college freshmen’s grade point averages (GPA). We utilize longitudinal data from a unique dataset with over 15,000 students who spent their academic careers in North Carolina public secondary schools and then attended North Carolina public universities. Our results suggest that “unjust” assignment of students to certain high schools, access to high-quality teachers, and assignment to learn in specific academic tracks result in long-lasting consequences that are reflected in freshman college GPA. Importantly, findings also show that the direction and magnitude of the relationship between distributional injustice at schools and college performance is moderated by students’ own gender and race. Race and gender interact with the high schools’ institutional contexts operationalized by tracking practices, teacher quality, and by school racial and socioeconomic composition. Results show that similar settings do not affect all students in the same ways.  相似文献

Much debate has taken place regarding the merits of aggressive policing strategies such as “stop, question, and frisk.” Labeling theory suggests that police contact may actually increase delinquency because youth who are stopped or arrested are excluded from conventional opportunities, adopt a deviant identity, and spend time with delinquent peers. But, few studies have examined the mechanisms through which police contact potentially enhances offending. The current study uses four waves of longitudinal data collected from middle‐school students (N = 2,127) in seven cities to examine the deviance amplification process. Outcomes are compared for youth with no police contact, those who were stopped by police, and those who were arrested. We use propensity score matching to control for preexisting differences among the three groups. Our findings indicate that compared with those with no contact, youth who are stopped or arrested report higher levels of future delinquency and that social bonds, deviant identity formation, and delinquent peers partially mediate the relationship between police contact and later offending. These findings suggest that programs targeted at reducing the negative consequences of police contact (i.e., poor academic achievement, deviant identity formation, and delinquent peer associations) might reduce the occurrence of secondary deviance.  相似文献

Power‐control theory posits that parental workplace positions affect adolescent law violation. To date, however, no test of the theory has directly measured occupational power and control. This paper tests whether parental and adolescent workplace freedom and control affect criminal behavior and arrest as the theory predicts, using data from a prospective longitudinal survey of 1, 000 adolescents and their parents. The results suggest sex differentials in the effects of maternal authority position and parental freedom and control. In particular, daughters whose mothers hold authority positions are more likely to be arrested than are daughters whose mothers do not hold such positions. The effects of adolescent employment also differ by sex, with perceived workplace power and control reducing rates of arrest among females but increasing them among males.  相似文献

This study examined domestic violence arrest statistics in a sheriff's department that does not utilize a community approach and provides little police training on domestic violence. In reviewing all domestic violence reports (n=1870) over a 12-month period, less than one-third (28.8%) of the domestic violence cases ended in arrest. Even the most serious charges (aggravated batteries) were more likely to end without an arrest (62.6%) than with an arrest (37.4%). Although results showed that more men were identified (88.4%) and arrested (91.6%) as batterers than women (11.6% and 8.4%, respectively), closer analyses revealed that arrested women were more often charged with more serious charges (60%) than arrested men (26.0%). Finally, gender and race data indicated that while four-fifths (84.6%) of black females were arrested on felony charges, less than one-fifth (19.5%) of white males were arrested on the same charge. Data were collected from three studies over an eight–year period, which produced a sample of 868 female college students at a southern university. The three data sets were combined to permit an assessment of the extent to which reported victimization occurred among students before coming to the university rather than during their college experience, and to examine the nature of force in intimate relationships among maturing adolescents. About half of the subjects reported that their last victimization occurred while in high school, thus they were younger and less mature at the time of their victimizations. The researchers note that these two factors raise concern as adolescent girls may not be prepared to adequately define or protect themselves from inappropriate use of force in dating relationships, as the literature reports that both the development of sexuality and a redefinition of the use of force in childhood play are occurring at this point in their development, increasing the potential for victimization.  相似文献

Scholars of human development argue that a variety of social contexts affect youth development and that the interdependency of these contexts bears on the shape of human lives. However, few studies of contextual effects have attempted to model the effects of school, neighborhood, and family context at the same time, or to explore the relative and interdependent impact of these contexts on youth outcomes. This study provides an examination of the independent and interdependent influences of school, neighborhood, and familial contexts through an analysis of student suspension and juvenile arrest. Findings reveal that school‐based and family‐based informal social controls additively combine to reduce the likelihood of suspension and arrest. Moreover, for suspension, results support the hypothesis that an interdependent compensatory relation is present between the extent of collective efficacy in schools and in the surrounding neighborhood; school collective efficacy has a controlling influence on the likelihood of suspension that becomes even stronger in the absence of neighborhood collective efficacy. However, for arrest, an accentuating effect of school‐based social controls exists rather than a compensatory effect. A lack of neighborhood collective efficacy and a lack of school‐based social controls combine to exert a substantial increase in the likelihood of arrest.  相似文献

Research shows that co-offending has contradictory effects on rates of re-arrest. On the one hand, group offending may be riskier: for example, co-offenders might be targeted by police or might snitch to protect themselves. Criminal networks may also have indirect effects: offenders embedded in criminal networks commit more offences and thus should have a higher risk of being arrested at some point. On the other hand, networks generate steady criminal opportunities with relatively low risk of arrest and high monetary benefits (e.g. drug trafficking). Few authors have empirically explored the relation between co-offending and re-arrest. This article does so using data from seven years of arrest records in the province of Quebec, Canada. The analysis is designed to explore why some offenders are re-arrested after an initial arrest while others are not. It focuses on the factors involved in re-arrest, considering two distinct levels of measures of co-offending. The first level of analysis takes into account a situational measure that indicates whether a given offence was committed by co-offenders (group offence). The second level is used to examine whether being part of a criminal network influences re-arrest. For offenders embedded in such networks, two network features (degree centrality and clustering coefficient) show that the global position of individuals within the Quebec arrest network are analysed. Our results suggest that co-offending is a crucial factor that should be taken into account when looking at the odds of being caught again. The use of generalised linear mixed model brings interesting nuances about the impact of co-offending. The article adds to the recently growing literature on the link between networks and criminal careers.  相似文献

Ample experimental evidence shows that the stigma of a prison record reduces employment opportunities (Pager, 2007). Yet background checks today uncover a much broader range of impropriety, including arrests for minor crimes never resulting in formal charges. This article probes the lesser boundaries of stigma, asking whether and how employers consider low‐level arrests in hiring decisions. Matched pairs of young African American and White men were sent to apply for 300 entry‐level jobs, with one member of each pair reporting a disorderly conduct arrest that did not lead to conviction. We find a modest but nontrivial effect, with employer callback rates about 4 percentage points lower for the experimental group than for the matched control group. Interviews with the audited employers suggest three mechanisms to account for the lesser stigma of misdemeanor arrests relative to felony convictions: 1) greater employer discretion and authority in the former case; 2) calibration of the severity, nature, and timing of the offense; and 3) a deeply held presumption of innocence, which contrasts the uncertainty of arrest with the greater certainty represented by convictions. In addition, personal contact and workplace diversity play important roles in the hiring process.  相似文献

Criminal background checks have now become ubiquitous because of advances in information technology and growing concerns about employer liability. Also, a large number of individual criminal records have accumulated and have been computerized in state repositories and commercial databases. As a result, many ex‐offenders seeking employment could be haunted by a stale record. Recidivism probability declines with time “clean,” so some point in time is reached when a person with a criminal record, who remained free of further contact with the criminal justice system, is of no greater risk than a counterpart of the same age—an indication of redemption from the mark of crime. Very little information exists on this measure of time until redemption and on how its value varies with the crime type and the offender's age at the time of the earlier event. Using data from a state criminal‐history repository, we estimate the declining hazard of rearrest with time clean. We first estimate a point of redemption as the time when the hazard intersects the age–crime curve, which represents the arrest risk for the general population of the same age. We also estimate another similar redemption point when the declining hazard comes “sufficiently close” to the hazard of those who have never been arrested. We estimate both measures of redemption as a function of the age and the crime type of the earlier arrest. These findings aid in the development of guidelines for the users of background checking and in developing regulations to enhance employment opportunities for ex‐offenders.  相似文献

For divorced parents, the question of who should pay for their child's college tuition is very difficult, especially when the issue was never addressed in their separation agreement. Consequently, some states allow judges the discretion to extend child support duties for noncustodial parents after considering certain factors. Such factors may lead to the requirement of parental contributions to their child's postsecondary education. While many states have amended their statutes to encompass extended child support, Pennsylvania is the only state to have found their statute unconstitutional. Based on the Pennsylvania Supreme Court decision in Curtis v. Kline, this Note argues that, in order to diminish inequalities between divorced and nondivorced parents, as well as between children of divorced and nondivorced parents, all states should amend their child support statutes to declare that no parent is obligated to pay for his/her child's postsecondary education, unless voluntarily agreed to, in writing, prior to the child entering college.  相似文献

In this study, we examined whether and to what extent the effects on offending of marriage and different types of cohabitating partnerships depend on the romantic partner's socioeconomic status (SES). Such research addresses a key gap in knowledge regarding potential heterogeneity of effects on behavior of romantic partnerships. Drawing on the National Longitudinal Survey of Youth 1997, we examined the within‐individual effects of three romantic partner's socioeconomic characteristics–education, employment, and income–on offending from ages 18 to 34. Results revealed that marriage was related to reductions in arrest only for those whose spouse was employed (full or part time) and had income. In contrast to marriage, partner SES was not related to arrest among those who cohabited with a partner they never married. Additionally, partner SES was often associated with reductions in arrest among those who cohabited with a partner they later married, but the reductions were statistically indistinguishable across levels of partner SES. Lastly, these effects were experienced similarly for low‐ and high‐SES individuals alike, and no gender differences were detected in these effects. Our findings suggest that important life events such as marriage and cohabitation can be behavior‐altering transitions, but the effects of these events are variable.  相似文献

A large body of research has consistently found that intensive employment during the school year is associated with heightened antisocial behavior. These findings have been influential in prompting policy recommendations to establish stricter limits on the number of hours that students can work during the school year. We reexamine the linkage between first‐time work at age 16 during the school year and problem behaviors. Our analysis uses group‐based trajectory modeling to stratify youths based on their developmental history of crime and substance abuse. This stratification serves to control for preexisting differences between workers and nonworkers and permits us to examine whether the effect of work on problem behaviors depends on the developmental history of those behaviors. Contrary to most prior research we find no overall effect of working on either criminal behavior or substance abuse. However, we do find some indication that work may have a salutary effect on these behaviors for some individuals who had followed trajectories of heightened criminal activity or substance abuse prior to their working for the first time.  相似文献

Approximately one third of U.S. high‐school freshmen do not earn their high‐school diploma on time. For African‐American and Hispanic students, this figure nearly reaches one half. The long‐term economic consequences of dropping out of school for both the student and the larger community have been well documented. It has also been argued that school dropouts put themselves at a higher risk for delinquent and criminal behavior when they leave school. Although it seems plausible that dropping out might increase the potential for delinquent conduct, another view states that dropping out is simply the final event in a long, gradual process of disenchantment and disengagement from school. Dropouts show evidence of school failure and developmental problems years in advance. It has been argued, therefore, that the actual event of finally leaving school has no causal effect on criminal or delinquent behavior because it has been so long in coming. In this article, we examine the effect of leaving school early, and the reason for dropping out, on delinquent behavior with the use of panel data models from the National Longitudinal Survey of Youth 1997 Cohort (NLSY97). Through an appeal to identity theory, we hypothesize that the effect of dropping out is not uniform but varies by the reason for leaving school, gender, and time. This conjecture receives only partial empirical support. Implications for future work in the area are discussed.  相似文献
