The federal government's adoption of the Oil Pollution Act of 1990 represented a radical statutory departure from past policy. Coastal oil spill control provisions that had languished for decades within the industry-friendly confines of a few select congressional subcommittees suddenly became law. Much popular belief credits the 1989 Exxon Valdez spill crisis for bringing about this radical policy change. Closer examination reveals that postcrisis policy change is much more complex. Crisis events intermingle with other short- and long-term factors that either inhibit or support dramatic change. This study analyzes change within the coastal spill arena over several decades. Particular attention is given to crisis episodes, periods identified with a major catastrophe or a successive series of attention-getting spills over a brief time. Analysis finds that crises can play an instrumental role in eliciting change.  相似文献

On January 7, 1994, the disabled tank barge Morris J. Berman ran aground spilling 750,000 gallons of heavy‐grade fuel oil on the beaches of San Juan, Puerto Rico. The spill impacted a variety of resources and temporarily shut down a portion of the tourist industry during the height of the winter season. The spill is noteworthy as the first major incident in U.S. coastal waters following passage of the Oil Pollution Act of 1990 (OPA 90). A landmark provision passed as a result of the 1989 Exxon Valdez catastrophe. The Berman spill provides a test case for assessing the robustness of policy mandates incorporated in the OPA 90. Mandates that compelled the oil transportation and response network to assume high‐reliability organization characteristics. The study finds that although high‐reliability characteristics were seemingly adopted their implementation during the Berman spill evidenced a significant number of shortcomings.  相似文献

This study examines the development of safeguards against marine oil pollution in Alaska since the 1989 Exxon Valdez disaster, in which oil spilled from the tanker Exxon Valdez polluted more than 2,000 kilometers of Alaskan coastline. Since 1989, a series of enduring institutional reforms have contributed to major enhancements in the safeguards against the continuing hazard of marine oil pollution in Alaska. This study is the first to comprehensively examine these new institutions and safeguards in two regions of Alaska with marine oil transportation systems. The major oil production streams of Alaska are transported through these two regions. In comparing the development of oil pollution safeguards in these two regions, this study finds a pattern of enduring yet unequal policy reforms.  相似文献

Scholarly research has found a weak and inconsistent role for self-interest in public opinion, and mixed evidence for a relationship between local pollution risks and support for environmental protection. In this study, I argue that focusing events can induce self-interested responses from people living in communities whose economies are implicated by the event. I leverage a unique 12-wave panel survey administered between 2008 and 2010 to analyze public opinion toward offshore oil drilling before and after the Deepwater Horizon oil spill. I find that residence in counties highly dependent upon the offshore drilling industry was predictive of pro-drilling attitudes following the spill, though not prior to the spill. In addition, there is no significant evidence that residence in a county afflicted by the spill influenced opinion. This study concludes that local support for drilling often arises only after focusing events make the issue salient.  相似文献

Current analyses of sexual identity and citizenship offer complexity to debates about what it means to be a citizen in liberal democratic societies. However, thus far there is limited inclusion of ethnographic, narrative‐based research that addresses how lesbians and gay men experience and negotiate citizenship in their everyday lives. In this paper, I argue that attitudes about medical power of attorney are a lens through which we can examine how lesbians negotiate and experience citizenship in their daily lives and in medical settings. My analysis demonstrates how normative citizenship structures are experienced, reinforced and challenged by four lesbians living in a community in Ontario's Near North region, Canada. In providing case illustrations, I argue that the inclusion of lived experiences strengthens and deepens textual, historical and political analyses of citizenship.  相似文献

Disasters challenge the equilibrium of regulatory regimes and make policy shifts more likely. Using an institutional theory of cultural biases and the concept of cultural “surprise”, this article analyses the direction and intensity of media argumentation in respect of policy shifts. Instead of assuming a demand for greater State intervention after dramatic focusing events, as suggested by other theoretical frames, cultural theory opens a variety of options that range from embracing regulatory responses from different cultural biases to the radicalization of current, but failing, instruments. The analysis of media reaction to the environmental disasters caused by the oil spills of Exxon Valdez (United States), Erika (France) and Prestige (Spain) shows that the demand for more hierarchy does not monopolize the overall argumentation. The change demanded often implies a radicalization of a particular prevalent view where the associated institutional setting is failing its supporters.  相似文献

Since the 1990s over 158 countries established pro‐market reforms in telecommunications—a fast pace for such a drastic change. For example, Sweden and Botswana, two nations vastly different across multiple dimensions, both liberalized their telecom sectors. Why did so many countries adopt liberal reforms in such a short period of time? Conventional wisdom highlights the role of global markets and technology, powerful states, global diffusion, and domestic politics. I argue that contrary to these claims, diffusion through key international organizations is the critical and overlooked factor in explaining rapid global convergence of pro‐market telecom reforms. Using an original dataset for 189 countries between 1970 and 2003 and event history analysis, I demonstrate that membership in key liberal trading organizations, especially the WTO and the OECD, increases the likelihood that countries will adopt liberal pro‐market reforms in telecommunications. These results speak directly to current public policy debates about the reregulation of global markets and bridges the literatures of policy diffusion, institutional design, and regulatory regimes.  相似文献

The April 20, 2010, BP Deepwater Horizon blowout riveted citizen and elected officials' attention on coastal oil spills in ways not seen since the ill‐fated 1989 Exxon Valdez crisis. A commonly voiced lament included why was the tragedy not prevented? Why the seemingly poor safety practices and who is to blame? Could a spill of such catastrophic proportion happen elsewhere in the future? Applying a spill prevention causation framework developed through the examination of other major near‐shore incidents over a 23‐year period, the author finds Deepwater Horizon exhibited a pattern of shortcomings evident in these other spills. These shortcomings are rooted in policy imperfections, a weak regulatory regime, organizational deviance in lieu of integrity, and interorganizational structure deficiencies.  相似文献

In this theoretical intervention, I argue that Karl Marx’s theory of value remains a powerful way to understand nature–society relations under capitalism. I suggest environmentalist critiques often misunderstand Marx’s value theory as a theory that “values” workers over nature. His critical theory is better understood as an explanation of how capitalist value exploits both workers and the environment. My defense of Marxian value theory is articulated through five “theses.” I provide empirical illustration based on recent research into the nitrogen fertilizer industry. (1) Value theory does not refer to all values. (2) Marx’s contention that nature does not contribute to value helps us explain its degradation under capitalism. (3) Marx’s value theory rooted in production allows for a critique of environmental economic valuation schemes (e.g. payments for ecosystem services) which are based on neoclassical value theories rooted in consumption/exchange. (4) Value is abstract social labor, but that means it also abstracts from nature. (5) Capital does value certain parts of nature and that matters. I conclude by advocating a “value theory of nature” in the spirit of Diane Elson’s powerful articulation of Marx’s “value theory of labor.”  相似文献

The Flash Crash of 6 May 2010 has an interesting status in discussions of high-frequency trading, i.e. fully automated, superfast computerized trading: it is invoked both as an important illustration of how this field of algorithmic trading operates and, more often, as an example of how fully automated trading algorithms are prone to run amok in unanticipated frenzy. In this paper, I discuss how and why the Flash Crash is being invoked as a significant event in debates about high-frequency trading and algo-financial markets. I analyse the mediatization of the event, as well as the variety of eventalizations of the Flash Crash - the different ways in which the Flash Crash is being mobilized as an illustrative event. I critically discuss the impact often associated with the Flash Crash – and on that basis, inquire into why the event nonetheless attracts so much attention. I suggest that a key reason why the Flash Crash is widely discussed is that eventalizations of 6 May 2010 evoke familiar tropes about the fear of technology and the fear of herding. Finally, and given their emphasis on herding, I argue that the Flash Crash eventalizations may contribute to discussions within economic sociology about resonance in quantitative finance.  相似文献

This article contributes to current debates on the potential and limitations of transnational environmental governance, addressing in particular the issue of how private and public regulation compete and/or reinforce each other – and with what results. One of the most influential approaches to emerge in recent years has been that of “orchestration.” But while recent discussions have focused on a narrow interpretation of orchestration as intermediation, we argue that there is analytical traction in studying orchestration as a combination of directive and facilitative tools. We also argue that a social network analytical perspective on orchestration can improve our understanding of how governments and international organizations can shape transnational environmental governance. Through a case study of aviation, we provide two contributions to these debates: first, we propose four analytical factors that facilitate the possible emergence of orchestration (issue visibility, interest alignment, issue scope, and regulatory fragmentation and uncertainty); and second, we argue that orchestrators are more likely to succeed when they employ two strategies: (i) they use a combination of directive and facilitative instruments, including the provision of feasible incentives for industry actors to change their behavior, backed up by regulation or a credible regulatory threat; and (ii) they are robustly embedded in, and involved in the formation of, the relevant transnational networks of actors and institutions that provide the infrastructure of governance. © 2017 JohnWiley & Sons Australia, Ltd  相似文献

This article examines Aquinas’s thinking about law and nature to show that for Aquinas natural law is not about deriving or finding normative rules (standards) in the order of the cosmos or requirements of practical rationality. Rather, I argue that for Aquinas, natural law is a distinctive way of theorizing relationality and embodiment in the “sublunary realm”: one that aims at “friendship” across species lines (STI-II99.2-3). The word Aquinas uses to describe this ecological practice is synderesis. For Aquinas, synderesis is both the human-creaturely capacity to grasp the analogical structuring of reality and the “disposition” that allows us to work on transforming this reality into belonging-together through our participation in natural law (STI79; DV15-17). Synderesis is thus of central importance to Aquinas’s account of natural law, yet it is largely overlooked by modern natural law theorists. The article concludes by exploring how Aquinas’s natural law thinking might contribute to an environmental politics of friendship.  相似文献

In debates about campus speech, there are arguments from the left and from the right that the community function of a college and the intellectual functions of a college can’t both be maximized. Improving the community role necessarily entails placing limits on the intellectual roles, and improving the intellectual role necessarily entails placing limits on the community roles. Where these arguments disagree is in the valuation of the tradeoffs between these roles. I argue that the apparent tension between the community role and intellectual role of colleges can be resolved, or at least mitigated, if we make a clearer distinction between speech and community endorsement of speech. What’s more, if we understand speech to be exploratory in nature rather than declaratory, we may remove some of the status competition between different groups that characterizes the dispute. This can allow for potential complementarities to emerge from the community support role of a college and the intellectual role. The core idea that I wish to explore is the notion of discovery that is embedded in Mill’s defense of free speech and in his conception of experiments in living. This approach depends on the idea that we can abandon the goal of defeating our opponents, and instead embrace the goal of accommodating one another.  相似文献

In the past few decades, the ‘return of the religious’ has been a recurrent theme in popular and academic discourse. From debates regarding the permissibility of religious dress and symbols in the public sphere, to questions of the integration of Muslim immigrants, concerns about the rise of the Christian Right in American politics and the role of Islam in the uprisings of the Arab Spring, a great deal of attention has been accorded to the presence of religion and religious subjects in the public sphere. Such has been the importance attached to accounting for, categorizing and contending with this phenomenon that it has attracted the attention of many of the major figures in contemporary social and political thought. However, the ideas of Jacques Rancière, one of the foremost figures in contemporary political philosophy, are noticeably absent in these discussions. In this article, I take up the task of investigating how Rancière's political philosophy can be brought to bear on debates surrounding the relationship between citizenship, religion and the political. I argue that his reconceptualization of politics, democracy and political subjectivity makes apparent the limitations, and even futility of current debates between advocates of secular universalism and those of religious pluralism, and, through assisting in the critical analysis of the public presence of religion, provide an opening for the potential emergence of alternative forms of community and political subjectivity.  相似文献

Abstract

This paper contributes to the understanding of the role of crowds in the financial market by examining the historical origins and theoretical underpinnings of contrarian investment philosophy. Developed in non-scientific, practice-oriented ‘how to’ handbooks in 1920s and 1930s America, contrarian investment advice was aimed at so-called small investors rather than well-established market practitioners. Emerging out of late-nineteenth- and early-twentieth-century debates about public participation in the stock market, the contrarians expanded on a widely held (amongst financial writers) scepticism about the investment and speculation skills (or lack thereof) of the masses and adopted ideas from the theoretical discipline of crowd psychology, whereby they positioned the mass (i.e. the crowd) in opposition to the successful investor. I argue that despite its idiosyncrasies, the contrarians’ conception of the market based on crowd psychology points to a fundamental fragility of market participants, which still lingers on in recent debates about the wisdom of financial market crowds.  相似文献

This article investigates how the sex of party heads impacts party positions and uncovers that parties led by a woman modify their stances on sociocultural but not economic debates. I argue that this pattern is a consequence of dissimilar gender gaps in policy preferences across the two ideological dimensions at the elite level. The empirical evidence, based on data for 19 developed democracies around the world between 1995 and 2018, reveals that parties led by a woman tend to emphasise green, alternative and libertarian issues. In particular, anti-growth, environmental protection and freedom and human rights become more prominent elements of party manifestos under women's leadership. Overall, these findings stress the importance of critical actors and the conditions under which the presence of women in political offices translates into responsiveness towards female citizens.  相似文献

In this article I draw on public sector reform knowledge in the United States, New Zealand and Australia. I argue that we, as practitioners, do not need to immerse ourselves in academic debates about 'positivism' or 'post-positivism'. These are frameworks for examining knowledge capable of validation. Instead, we are now engaged in using diverse forms of knowledge to spread the word on what works and does not work to deliver outcomes. Such knowledge is not above reproach; it is not acceptable merely because it exists but nor is it unacceptable because it cannot be rigorously validated in a positivist way.  相似文献

The year 2017 marks 45 years since the first English publication of Marx’s ‘Notes on machines’ in Economy and Society. This paper critiques how Marx’s ‘Fragment’ has subsequently been repurposed in postoperaist thought, and how this wields influence on contemporary left thinking via the work of Paul Mason. Changes in labour lead proponents to posit a ‘crisis of measurability’ and an incipient communism. I use the ‘New Reading of Marx’, which picks up where debates in Economy and Society in the 1970s left off, to dispute this. Based on an analysis of value as a social form undergirded in antagonistic social relations, I argue that the Fragment’s reception runs contrary to Marx’s critique of political economy as a critical theory of society, with implications for left praxis today.  相似文献

Political advertising on Facebook is the latest in a long line of developments in campaign practice, and is a tool that has been mobilised extensively in elections around the world. In this article, we explore what we know about Facebook advertising at elections and ask what existing data from the UK Electoral Commission can reveal about current usage. Highlighting the principles behind Facebook advertising, we argue that existing metrics offer little insight into current campaign trends—posing analytical, methodological and normative challenges for academics and electoral regulators alike. Moreover, we argue that these challenges strike at the heart of debates about democratic responsibility and the degree to which governments should cede responsibility to commercial actors who may have differing understandings of fundamental democratic norms.  相似文献
