在我国刑事诉讼案件职能管辖中,公安机关与人民法院的分工存在交叉。人民法院自诉范围的扩大化,不仅不符合国际立法的趋势,也给被害人行使控告权带来了许多限制,妨碍其获得司法救济。大量自诉案件的公诉化,给实际操作也造成了混乱。立法应对自诉案件的范围做一调整,将有暴力、隐蔽特征、取证困难的案件划归公安机关管辖,尽量避免自诉案件的公诉化,以明确两部门之间的立案分工。  相似文献

This article is a nontechnical presentation of the debate that has gone on during the past decade over whether the U.S. social security system has depressed private saving in the economy. The heart of the article is an assessment of economist Martin Feldstein's original evidence, presentation of the alternative evidence that concluded that currently available historical data do not support the proposition that social security reduces private saving, and an evaluation of the contradictory evidence presented by Feldstein in response to the alternative evidence. The article concludes that, although the total body of evidence is inconclusive, the historical evidence fails to support the hypothesis that social security has reduced private saving. The Office of Research, Statistics, and International Policy, as part of its ongoing research mission, investigates the interrelationship between social security and the economy. This article presents an examination of one of several aspects of this relationship relevant to public policy considerations and is intended to make previously published technical papers available to a broader audience.  相似文献

In an attempt to reap the purported benefits that "knowledge workers" bring to organizations, many police departments have shifted to a community problem–oriented policing philosophy. Rather than focusing on enforcement and incarceration, this philosophy is based on the dissemination of information to promote a proactive, preventative approach to reduce crime and disorder. In keeping with much of the contemporary literature on the "learning organization" (sometimes called the "knowledge organization"), police departments hope to deter crime through the knowledge benefits that derive from information and its associated technologies. With goals to stimulate productivity, performance, and effectiveness, police departments across the country are employing information technology to turn police officers into problem solvers and to leverage their intellectual capital to preempt crime and neighborhood deterioration.
Many public and private organizations are striving to change their operations toward this same concept of the knowledge worker. Information technology is often touted as a vehicle for capturing, tracking, sorting, and providing information to advance knowledge, thus leading to improvements in service–delivery efforts. Based on an extensive study of police departments that have attempted to implement a knowledge–worker paradigm (supported by information technology initiatives), this research explores the feasibility, effectiveness, and limitations of information and technology in promoting the learning organization in the public sector.  相似文献

In the Palestinian case, the police officers tried to provide some requirements and undertake some development initiatives. The issue of accountability was the most important part of them. Therefore, this research provides an assessment and analysis for the issue of accountability in the Palestinian police. It aims to identify the relationship and impact on the development of police performance. The researchers used a questionnaire for this purpose, which was distributed to a sample of 332 police personnel in the four largest police departments in the West Bank. The SPSS software was used to analyze the data. The results indicated that the elements of the Palestinian police system are subject to accountability through clear structures, mechanisms, procedures, and standards from inside and outside of the system. This system of accountability has a clear impact on the development and improvement of the performance of police elements.  相似文献

One of the most frequently used arguments supporting the introduction of privatization into a prison system is that it will strengthen accountability. However, to meet this claim it is maintained that a number of preconditions are necessary—one being independence of the regulator. This article examines the claims made by the Victorian Minister for Corrections that the Seamless System model would provide more independent monitoring and review of Victoria's prisons. Changes to regulatory arrangements are probed to determine if there has been any loss of independence in Victoria's prison system since the introduction of the latest model. It is concluded that the latest restructuring in 2003 of Victoria's part-privatised prison poses a significant risk for public accountability and requires attention to ensure both the private and the public prisons are held to account.  相似文献

The Royal Commission into Aboriginal Deaths in Custody attributed the high rate of Aboriginal deaths in custody to the over-representation of Aboriginal people in prison. Most analyses of this over-representation focus on the issue of systemic bias in policing, the law or the operation of the criminal justice system. The present article contends that, while discriminatory treatment of Aboriginal people by police and the court system is an historical fact, the leading current cause of Aboriginal over-representation in prison is not systemic bias but high rates of Aboriginal involvement in serious crime. We argue that efforts to reduce Aboriginal imprisonment rates through policing or criminal justice system policy have failed and will continue to fail until they succeed in reducing crime in Aboriginal communities. Future efforts to bring down Aboriginal imprisonment rates should focus on this issue.  相似文献

The increasing salience of security concerns after democratization processes in the developing world has put scholars to explore the effects of police corruption as a key issue impeding the consolidation of the rule of law. Using data taken from surveys conducted in Mexico, Peru, and Bolivia, this article contributes to such literature by questioning whether cases of police corruption have an effect on the trust in the political system. The research finds that citizens can support the democratic order even if they have experienced bribery. The article unveils, however, that another type of police corruption—police protecting criminals—is a robust and statistically significant theory of variance in the confidence in the political system.  相似文献

Queensland has two prisons run by private companies; the first contract was signed in 1989. In 1995 a competitive tender for a new prison was won by the QCSC against two private providers. Further, there is now a belief that prisons should be run on commercial grounds. The principal agency, the Queensland Corrective Services Commission (QCSC) has been divided into two bodies — a purchaser and a provider — to allow markets to prevail in Queensland corrective services. What can be learnt from these developments? This article will, first, provide a brief history of the changes; second, it will explore whether the initial objectives for the introduction of the private sector into the corrective system have been met; and third it will ask whether market forces can or should be a dominant feature and hence whether a corrective services system can or should be organised on a commercial basis.  相似文献

Security Sector Reform is an integral part of peace-building but the focus of international actors tends to be on formal state security providers. This article argues that reforms in the judicial system are key for the non-violent transformation of societal conflicts. Based on historical institutionalism a theoretical argument links justice and peace. Reforms of the judiciary need to be an integral part of SSR because otherwise reforms in the military and the police can easily be undermined or turned back. A case study on El Salvador provides empirical insights on the interrelation between reforms of these institutions.  相似文献

The enfranchisement of non‐resident citizens has always been controversial in the UK, where for historical reasons, voting rights are not as closely associated with citizenship as elsewhere. The introduction of ‘overseas’ voting in the 1980s by the Conservatives was contested by Labour as a form of ‘international gerrymandering’ since expatriates were widely assumed to be disproportionately wealthy and therefore more likely to vote Tory. Expatriate campaigners have been increasingly vocal in denouncing the ‘electoral injustice’ of the ‘fifteen‐year rule’ which disenfranchises them after fifteen years abroad, and the exclusion of so many from the EU referendum highlighted their cause. A recent private member's bill proposing ‘votes for life’ for UK expatriates aimed to meet their demands to abolish the time restriction, now considered anachronistic. But their arguments were hijacked by historically embedded attitudes and disputes driven by party politics, ending in a dramatic and bewildering filibuster which this paper elucidates.  相似文献

Abstract. The size of the private security industry has increased substantially in recent decades. While previous research has focused on the industry's growth trajectory, less emphasis has been placed on explaining the nature and diversity of private security services. This article investigates the possibility of studying private security with the feudal model. Feudalism is introduced as an ideal type and the paper explains why it is necessary for understanding the independent control of violent force—termed here as ‘private coercion’—in contemporary society. The feudal model provides a unique historical lens through which to re-examine previous studies on this subject. In many ways, private coercion is incongruent with the traditional vision of liberal, capitalist society. The feudal model reveals these inconsistencies as it identifies private coercion as a means of creating wealth that violates the state's monopoly on violence, challenges the public sphere of governance and redefines the boundaries between public and private space. This article suggests that any explanation of modern modes of securing life and property is incomplete without the feudal model.  相似文献

In the last half decade, cyber insurance has emerged as a multi-billion-dollar industry with the authority to set and enforce standards of security behavior. Although cybersecurity has become a concern of national policymakers, insurers appear to have supplanted the state to play an influential role in governing some aspects of client behavior. This paper explores private governance by cyber insurance firms and evaluates two competing explanations for its emergence – either that the private sector advanced to set and enforce cybersecurity standards for financial gain, or that the state retreated from its responsibility to regulate and private sector actors filled the gap only as necessary. To find an answer between these explanations, this article develops a single outcome case study of the American cyber insurance industry. Following a theoretical introduction to private governance and its manifestation through insurance, the article examines the insurance process and its application in cybersecurity, the key role of standards, and the mechanism of enforcing those standards. The article concludes by identifying key elements of this market-based enforcement and discussing implications for crafting effective private governance in other domains and public policy.  相似文献
