高校模拟法庭教学活动的现状及发展——从学生视角出发

模拟法庭教学是近年在高校法学教研中兴起的,符合深化法学实践教学改革要求,以培养新兴实务型法学人才为目的的法学教学模式。目前,程序表演型模拟法庭和实战型模拟法庭竞赛均存有不足。因此,为使模拟法庭能够更加有效的成为法学教育的创新力量和法科学生迈向实务领域的桥梁,探寻学生主体对模拟法庭教学活动的模式选择并对未来的模拟法庭教学发展完善提出建议,显得极为必要。     

课程型模拟法庭在法科实践教学的应用

法科学生就业率低反映了法学教育实践环节薄弱.不同类型的模拟法庭因其价值取向不同而产生不同的社会效果.课程型模拟法庭能够满足培养、训练和提高法科学生法律实践能力的需求.课程型模拟法庭在法科实践教学的应用是提高法科学生法律实践能力的有效教学方式.模拟法庭课程欲实现教学目的,应加强、完善和注意下列教学环节：课程安排在第七学期,选任双师型的指导老师,选择有代表性的案例,对学生进行合理分组,指导与制作法律文书,及时点评模拟法庭及对学生确立科学的考核体系.     

论地方高校模拟法庭实践教学的改革

地方高校虽然广泛开设了模拟法庭实践课程,但效果并不理想,存在一些不足,有必要进行教学改革。将地方高校模拟法庭实践教学改革的目标定位为实战与逼真,能充分发挥学生的主观能动性,切实提高学生的法律实务操作能力。地方高校模拟法庭实践教学改革既涉及教学内容的改革,也涉及教学方法的革新。     

课程论视阈中的高校模拟法庭课程教学

从课程论的视阈来看,模拟法庭课程的设置动因是法律应用型人才培养目标与提高我国高校法学教育质量的需要,其教学理论依据为活动中心课程模式理论与范例教学理论;模拟法庭课程具有能动学习、知识迁移、专业技能与法律素质养成、社会化等功能,其一般教学步骤为精心选定案例、学生分组准备开庭材料、模拟开庭、综合讲评、卷宗材料整理归档、评定参加者的成绩。     

公安法学教育改革与实践性教育模式——论诊所式教学法在公安法学教学中的运用

近年来随着公安教育改革的推进,国内许多公安院校在法学教学中都作了一些有益的尝试,逐步采用了案例教学法、模拟法庭教学法、课堂辩论教学法等,对于培养学生理解法律的能力起到了重要的作用。但是,这些教学方法对于学生真实法律技能的训练和职业道德的培养都不是十分有效。“诊所式法律课程”是加强实践教学的一种新的教育模式。在公安法学教学中逐步推进诊所式教育模式的开展,可以解决公安法学教育中长期以来存在的一些问题,进一步促进公安教育改革深入进行。

外国刑法学教学思考

外国刑法学,作为一门研究外国刑法理论与刑法制度的学科有广泛开设的必要性。但在教学实践中,存在教学内容不均衡、教学方法不丰富及教学资源不充足的尴尬。反思外国刑法学教学尴尬之余,须重新定位外国刑法学的教学目标,其应当是传递法律价值观念,弘扬法律比较精神。本着理论与实践并重的思路进行适合于本课程教学的新尝试,包括小组讨论、课堂辩论和模拟法庭等。

共享法庭制度化发展的现实困境与优化路径——基于浙江省的实证考察

共享法庭作为浙江省全域数字法院建设项目是新经济形势下的重要制度创新。数字化驱动司法系统性重塑的重要制度创新，真正将司法服务送到了群众家门口，其运行实效关系到基层诉源治理法治化，关系到共同富裕下司法公共服务优质普惠共享先行示范。通过实证考察发现，共享法庭主要有镇街、村社、特设共享法庭三种模式，因其功能丰富，又极具便利性、灵活性与融合性而深受好评。但在其制度化发展过程中，仍存在职能定位模糊且各地重视程度不一，人员选任与工作分配、工作人员保障机制不健全等现实困境。为了促进共享法庭的良性发展，需要精准定位共享法庭职能，推动共享法庭规范化发展，并且充分发挥共享法庭融合性，探索创新“共享法庭+”模式，同时加强工作队伍建设，完善人员保障机制。
