This essay describes the four broad themes that emerged from our discussionabout the role of process in cross-cultural negotiations and considerstheir implications for future research. First, we address the nature of theconflict, in particular whether a negotiation is classified as a dispute or atransactional exchange. Second, we contrast the role of cognition and rapportin negotiations and consider when rapport replaces the centrality ofcognition. We also discuss the extent to which negotiating processes createrelationships based on trust or power, and consider how cultural valuesinfluence the development of these underlying relationships. Finally, weconsider the role of culture in defining what is perceived as an optimal outcomeand raise the possibility that suboptimal outcomes may holdsymbolic value in cross-cultural negotiations.  相似文献

This article explores the impact that different perceptions of time may have on cross-cultural negotiations. Beyond obvious issues of punctuality and timekeeping, differences may occur in the value placed on the uses of time and the priorities given to past, present, or future orientations. The role of time in negotiations involves two key dimensions: differing perceptions and values of time, and the management of time. This article examines one especially challenging aspect of active-learning international studies courses—the use of cross-cultural simulations. What is the significance of culture for negotiation? What difficulties might cross-cultural negotiations pose, and how might negotiators work with cultural differences to achieve successful outcomes? Is it possible to model the effects of cultures on negotiators in a classroom role-play? What are the advantages to using cross-cultural simulations, and what difficulties do they entail? How might an instructor make best use of materials that focus on cultural issues and their effect on negotiation? When teaching students of different cultures by active-learning methods, what ought an instructor to bear in mind? Instrumentalism, the philosophy that rational people will behave in ways that promote self‐interest, is often the default assumption that scholars and practitioners rely upon when interpreting and predicting human behavior in negotiations. Instrumentalism, however, need not be the only lens through which negotiators and negotiations are viewed. In this article, we discuss some of the problems associated with too heavy a reliance on instrumentalism and propose an alternative relational approach, one in which negotiators see themselves as agents embedded in a system of relationships, who are motivated to understand and advance the welfare of others. We discuss some of the characteristics that differentiate negotiators who adopt a relational versus instrumental approach and invite scholars and practitioners to consider the implications of viewing negotiations through a more relational lens.  相似文献

Negotiation analysis of climate change–related issues has largely focused on public dispute resolution mechanisms that are typically applied in the face of specific environmental crises, or on multiparty diplomacy relating to international climate agreements. Mayors and other municipal leaders, however, are increasingly taking steps to negotiate urban planning efforts with stakeholders to implement policies for managing the intensifying impact of climate change. In this article, we analyze negotiations in Houston, Texas, and Fort Lauderdale, Florida, to identify which methods municipal leaders employed to conduct negotiations to implement climate adaptation policies and also consider whether those methods were effective. The two cities present two differing city management structures: Houston has a strong mayor‐driven system, while Fort Lauderdale uses a city commission and city manager system. In this article, we examine the barriers that leaders must overcome and consider their options for negotiating lasting agreements.  相似文献

In this article, we seek to apply the insights of recent research on routine to the context of repeated negotiations. To demonstrate the link between both concepts, we introduce an analytical framework in which we identify different negotiation situations in which routine can develop. We distinguish two dimensions of the negotiation process: a problem-solving dimension and a communication dimension. Our framework for analyzing the role of routine in negotiation is built around these two dimensions. We define those skills that we argue in repeated negotiations can help negotiators manage particular kinds of negotiations depending on the level and type of routinization that type of negotiation involves. Moreover, we demonstrate that our framework is inherently dynamic, which we illustrate with simplified business examples.  相似文献

The role of small states has been largely neglected in research on the process and outcome of multilateral negotiations. Even though these states may be active in the agenda-setting processes or display a specific engagement in certain thematic aspects of negotiations, in the end game the outcome of negotiations has been perceived to be dependent on the bargaining between major powers. However, small states also have strategies at their disposal to compensate for these weaknesses. Two principal ones come to mind, prioritization or niche diplomacy, and coalition-building to join forces with like-minded states in order to draw on their resources, expertise and manpower. In the article, we compare two cases of small state coalitions in multilateral negotiations, namely the Like Minded (LM) group in the negotiations that led to the establishment of the International Criminal Court (ICC), and the Alliance of Small Island States (AOSIS) in United Nations climate negotiations. While the two coalitions resort to similar strategies, they have not been comparably successful. We will show that the ability to translate discursive power into measurable effects on outcomes ultimately depends on the institutional setting of the negotiations and the nature of the issue that coalitions are tackling.  相似文献

Within a negotiation, when an act by one party is out-of-keeping with the previous moves and underlying logic of the interaction, the act and those that follow hold the potential for creating a transition to a new logic of interaction. In this paper, we investigate the presence and role of seven distinct types of transitions resulting from out-of-keeping acts across ten complex legal negotiations. The data reveal that a critical feature differentiating across the types is the abruptness/gradualness of the transition. We explore the combination of relational, informational, and procedural acts comprising the transitions and find that all three components are present across transitions, but in different proportions and orders. Understanding the role of out-of-keeping acts in negotiations facilitates a more complete picture of the microprocesses involved in the creation of critical moments in negotiations.  相似文献

This article examines how perceptions of time affect Arabic-speaking Islamic negotiators and how their attitudes about time, and their corresponding behaviors, may differ from those of their Western counterparts. We begin by identifying cultural differences in the conceptualization of time and then comment on the role of time in negotiations, discussing how time influences bargaining, trust, and negotiation tactics. In the section on tactics, we discuss stall-and-delay tactics, the use of the past as an objective standard, and limits on negotiating the future. Our purpose is to encourage negotiators from the West to be knowledgeable about the way they, as well as negotiators from Arabic-speaking Islamic cultures, conceive of and use time in negotiations. We believe that understanding that the very concept of time is often quite different in these two cultures is an important step in facilitating negotiations that cross these cultural boundaries.  相似文献

Despite their widely recognized benefits, integrative approaches to negotiation have seldom been effectively used in interorganizational negotiations. This study analyzes the 1987–1995 Korea–United States Trade Negotiations, identifying elements in those talks that could have moved the negotiations in a more integrative direction. The role of building relationships — especially between key negotiators — is examined. Informal negotiations between the key negotiators from both sides were crucial in building such relationships, which helped both sides create solutions for mutual gains. This process was realized, inter alia, by the dual role that the key negotiators took on as negotiators and as mediators.  相似文献

In this article, we examine the roles of focal points and turning points in negotiation. Both concern impasses in negotiation, and negotiators can exploit them to move past impasses. Each term uses the word “point” differently, however. A focal point refers to a single salient coordinating concept shared by the parties. A turning point is a departure that takes place during the course of a negotiation, when the course seems to change. Precipitants precede turning points and consequences follow them. In this article, we focus on the relationship of these two negotiation concepts. We raise the following questions: Does the development of focal points precipitate departures, and, if so, how? Do departures lead to the development of focal points, and, if so, how? Are there circumstances in which focal points do not precipitate turning points and vice versa? Do negotiations that feature focal points create more or less durable agreements? Do negotiations that include turning points create more or less durable agreements? To help answer these questions, we have analyzed four cases. In the German Foundation Agreement negotiation, the development of focal points precipitated turning points. In the South African Interim Constitution negotiations, turning point departures precipitated the development of focal points. And in the negotiations to end the Burundi civil war and to reach the Nouméa Accord between France and New Caledonia, parties shared focal points that did not precipitate turning points. These case analyses provide insights into the role of focal points in producing effective and durable agreements. They also suggest opportunities for further research on the interaction between these concepts.  相似文献

Using the 2005 unilateral Israeli withdrawal from Gaza as a case study, this article exposes an apparent paradox: circumstances may exist in which an outcome that serves the interests of parties to a conflict cannot be achieved through bilateral negotiation but can be achieved by unilateral action. Although the withdrawal was seen at the time as serving the interests of both the Israeli government and the Palestinians, we argue that the same result could not have been achieved through bilateral negotiations. “Behind‐the‐table” internal conflicts on each side would have made it impossible for the leaders to agree on the scope of these negotiations. Prime Minister Ariel Sharon's success in implementing his Gaza withdrawal was attributable in significant measure to his ability to maintain ambiguity about his long‐run plans for the West Bank. Only by focusing attention on Gaza was he able to build the necessary coalition to implement the controversial move. The Palestinian leaders, on the other hand, could never have agreed to come to the table to negotiate about Gaza alone — they would have insisted that the scope of any negotiations address a broad range of final status issues. In this article, we identify some of the lessons that the Gaza example teaches regarding the utility and limits of unilateralism as well as the benefits and potential costs of employing ambiguity as a strategy to help accomplish a controversial move. Finally, we also explore the aftermath of the withdrawal and its many missed opportunities for improving the outcome. We suggest that, even when acting unilaterally, leaders should carefully consider the probable impact of their actions on the internal conflicts of their adversaries.  相似文献

This article discusses the pedagogical value of using remote role plays in cross‐cultural negotiations between two classes taught simultaneously at different and geographically distant institutions. We argue that remote role‐play simulations provide valuable teaching and learning experiences, and are particularly helpful for managing issues associated with outside‐group negotiation and cultural differences, the prenegotiation stage, electronic negotiations and distorted communication, and one‐shot settings in which the negotiator lacks previous knowledge of the partner. The article begins with a discussion of some critical limitations of “traditional” in‐class role plays, followed by a practical guide to remote role plays and a report of our experiences with them. Finally, we discuss the advantages and disadvantages of remote role plays as a teaching tool for international negotiation classes and the key lessons for the participating students.  相似文献

Private diplomacy and secret agreements among adversaries are major features of international relations. Sometimes secret reassurance has resulted in cooperation and even peace between longtime adversaries. Yet rationalist theories consider private diplomatic communication as cheap talk. How do we explain this gap between theoretical expectations and the empirical record? I offer a theory that explains how, why, and when a leader may convince an enemy that his private reassurances are credible even when they are not costly to undertake. I also account for the conditions under which recipients of such reassurance infer the leader's benign intentions from these secret interactions. I claim that leaders engage in secret reassurance with the enemy when they face significant domestic opposition. The adversary can leverage the initiator's domestic vulnerability by revealing the secret reassurance, thereby imposing domestic punishment on the initiator. Further, by entering into private or secret negotiations and offering their adversary such leverage, initiators generate “autonomous risk” that exists beyond their control. I evaluate this theory against two empirical cases. The first case looks at Richard Nixon's secret assurances to the Chinese leadership in 1972. The second examines the secret negotiations between Israeli officials and the leadership of the Palestine Liberation Organization that ended with the signing of the Oslo I Accord in 1993.  相似文献

Abstract

Scholars have long viewed parliamentarians as parochial actors having little interest, or incentive to engage, in international diplomacy. Yet, parliaments have recently taken on a very active role in various international negotiations. This article explores the role of the European Parliament (EP) in the European Union (EU)–Canada Comprehensive Economic and Trade Agreement (CETA) and the EU–United States Transatlantic Trade and Investment Partnership (TTIP) negotiations. Drawing on classic institutionalist insights, it develops the concept of parliamentary assertion and explores its usefulness through a combination of comparative and process-tracing analyses. The conclusions are threefold: (1) the EP has asserted its power in international trade matters beyond the simple power of consent; (2) the EP’s search for legitimacy in the EU polity is driving this phenomenon; and (3) this phenomenon is significant beyond the current CETA and TTIP negotiations.  相似文献

Negotiation researchers have conducted a large number of experimental lab studies to identify the factors that affect negotiation outcomes, but it remains unclear whether those results can be generalized to real‐world negotiations. To explore this question, we analyzed the dynamic international iron ore annual negotiations that took place from 2005 to 2009. We found evidence that supports two important findings from previous experiments. Specifically, we focused on the impact of negotiators’ best alternatives and first offers on negotiation prices using multiple case study analysis. We found that iron ore prices increased more when the gap between the previous year's negotiated price and the price on the alternative spot market, a public market in which commodities are traded for immediate delivery, was larger, which suggested that buyers were sensitive to the strength of this alternative, supporting the literature on the role of alternatives. We also found that the first offer price significantly influenced the final price. Our findings extend two important experimental findings from the negotiation literature to large‐scale business negotiations in the real world.  相似文献

Preferences are a crucial element for analyzing decision making and negotiations, but knowledge about which factors determine these preferences is sparse. Some quantitative and qualitative studies of European Union (EU) negotiations have assumed that the negotiation conflict dimensions in intergovernmental negotiations reflect market‐versus‐regulation approaches as well as a north–south dimension. In this study, I demonstrate that these findings can be extended to show that the relevant determining factors for negotiation positions are economic structural variables and the degree to which a country benefits from the EU. Furthermore, the domestic interests of EU governments better explain a government's interest in some specific issues, such as consumer protection or fishery policies, than do their partisan preferences. Moreover, I am able to show that in frequent negotiations, such as EU Council of Ministers negotiations, sincere preferences dominate; however, some factors, such as extreme salience, can increase the likelihood that a minister will choose a less sincere strategic position such as an extreme position.  相似文献

There is no broad literature defining conservative internationalism as there is for liberal internationalism and realism. Yet conservative internationalism differs from liberal internationalism and realism in four important ways. First, it seeks a world of limited government or separate sovereign nations not big international institutions. Second, it believes that national security is a function of ideological differences not just relative power or diplomatic misunderstandings. The democratic peace is a much safer world for America than the balance of power or United Nations. Third, it recognizes the need to use force during negotiations, not just after negotiations fail, because authoritarian states will not take negotiations seriously if they can achieve their objectives outside negotiations. And fourth, it advances democracy conservatively by prioritizing regions where strong democracies exist nearby (today Ukraine and Korea) and by using military leverage to reach timely compromises that weaken authoritarian states.  相似文献

Multilateral negotiations at the World Trade Organization have stalled. This has contributed to a steep rise in preferential trade agreements (PTAs). At the same time, negotiations for PTAs have not always proven quick and painless: While some treaties are sealed within a few months or days only, other agreements are preceded by protracted bargaining processes in trade and trade-related issue areas. In this article, we provide a theoretical explanation for this empirical variation. More specifically, we argue that PTA negotiations take longer the greater the distance between the prospective partners’ initial bargaining positions. Moreover, we contend that negotiation processes become more protracted the higher the relative ambition of the prospective PTA. Due to the limited links to the domestic political arena in autocracies, we expect this latter effect to play out for groups of democratic bargaining partners only. We test these two hypotheses for 198 preferential trade negotiations using novel measures for bargaining templates and the ambition of PTA clauses. In our two-stage survival models, we find support for our argument. In line with qualitative evidence from recent preferential trade initiatives, our models indicate that services, investment and intellectual property rights are particularly sticky agenda items for democratic leaders at the international bargaining table.  相似文献
