《欧盟宪法条约》框架下的欧盟机构改革

2004年 10月,欧盟各成员国在罗马签署了《欧盟宪法条约》,这标志着欧盟政治一体化进入了一个崭新的阶段。该条约涉及欧盟政治与经济生活的方方面面,其中最令人关注的莫过于其对欧盟机构体系所进行的改革。《欧盟宪法条约》对欧盟机构体系改革规定了诸多内容,但改革中仍存不足。     

《里斯本条约》中双重表决制对欧盟的作用

2009年捷克领导人签署了《里斯本条约》后,代表着该条约在2009年12月1日正式生效。而这部条约的生效对持续了几十年的欧洲一体化进程有着非常重要的意义,双重表决制是《里斯本条约》与之前的《欧盟宪法条约》变化最大的部分。本文通过欧盟表决制度的前后变化来分析其对欧盟的作用。     

从宪法条约看欧盟与成员国之间的权力分配——兼评法、荷对宪法条约的否决以及欧盟的意义

为了解《建立欧洲宪法的条约》中对于成员国与欧盟机构之间的权力分配,本文从:欧盟权限的范围、欧盟如何在其授权范围内进行立法决策、欧盟法的效力等三个角度对该条约进行了分析。可以看出,宪法在对欧盟进行广泛授权的同时,仍然从根本上维护了成员国的主权,宪法条约并没有从根本上推进原有的条约体系已经达到的一体化的程度。但兼顾了一体化和各民族特征的欧盟本身正是二十世纪政治文明最重要的创新性成果,是其他国家和地区学习的典范。     

论欧盟的性质与发展方向

欧洲联盟是当今世界区域一体化发展的典范,虽然《欧盟宪法条约》的生效暂时受阻,但是欧洲一体化进程是难以阻挡的。本文通过对欧盟现状和特征方面的分析论证,从一个更为清晰的角度认识了欧盟的性质与发展方向。     

浅析欧盟劳动者自由流动制度

以劳动者自由流动为代表的人员自由流动制度的建成是欧洲一体化进程的重要标志,也是统一欧洲政治经济的基础性制度。本文从适用主体、权利内容和权利限制三个方面入手,结合欧盟基础性条约、二级立法和以往判例,对劳动者自由流动制度进行简要分析,并指出其重要性。     

欧盟国家责任原则探析

依照《建立欧洲经济共同体条约》(以下简称《罗马条约》) ,欧洲法院对于私人诉讼主体对成员国提起的诉讼是没有管辖权的 ,但是在实践中对于个人因国家违反欧盟法的行为而带来的损失应如何寻求救济 ,欧洲法院在Ｆｒａｎ ｃｏｖｉｃｈ案等一系列案件中 ,借助于第 1 77条赋予欧洲法院的初步裁决权和第 5条向成员国规定的义务 ,确立了国家对于违反欧盟法律给个人带来损害而承担的责任———国家责任。一、国家责任 (ｓｔａｔｅｌｉａｂｉｌｉｔｙ)的确立根据《罗马条约》的规定 ,欧洲法院的诉讼管辖权仅限于两种 ,即一个成员国或代表欧盟的一个…

欧盟作为世界上一体化程度最高的区域性政治经济组织,欧盟在经济一体化道路上走得比较深入,但政治与法律一体化却进程缓慢。本文阐述了欧盟法律一体化进程中的难点问题,分析了欧盟法律一体化进程缓慢的原因,并论述欧盟一体化的全球意义及对东北亚的启示作用。     

欧盟"版权指令"述评

1996年 1 2月 ,世界知识产权组织主持的外交会议缔结了《世界知识产权组织版权条约》(ＷＣＴ)和《世界知识产权组织表演和录音制品条约》(ＷＰＰＴ)。随后 ,欧共体即开始制定实施上述两个条约的指令。 1 997年 1 2月 1 0日 ,欧盟委员会 (也即欧共体委员会 )向欧盟议会和欧盟理事会提出了《关于协调信息社会中版权与相关权某些方面的指令建议》 ,简称“版权指令草案”。〔 1〕其中的“信息社会” ,在欧盟的相关词汇中就是指国际互联网。〔 2〕因此 ,这是一个有关网络环境中版权与相关权保护的指令草案。欧盟议会在详细审议了“版权指令草案”…     

《欧盟宪法条约》对欧盟人权保护的影响

《欧盟宪法条约》的通过和生效将从根本上矫正欧盟经济、政治、军事和人权的不对称性,并使欧盟的人权保护从政治层面提升到司法层面。这一条约还从根本上弥补了欧盟的“人权赤字”,并使欧盟的人权保护制度与欧洲理事会的人权保护制度相连结,使欧盟的人权保护由点扩大到面。可以期待,随着条约的生效和施行,欧盟的人权保护将逐步处于区域性和全球性人权保护的领跑地位。
