先秦至唐宋时期武陵地区民族关系简论

早在先秦时期,巴人和三苗的一支即已在武陵地区生存繁衍,发展成为现今武陵地区的两大主体民族:土家族和苗族。自汉代起,汉人就以相当的规模进入本地区。持续的人口流动奠定了现今武陵地区以土家族、苗族、汉族为主体,各民族大杂居、小聚居的分布格局。在长期的历史进程中,各民族间形成了共生共存、博弈互惠的密切关系。     

网络直播用工关系的劳动法思考

网络直播行业光鲜亮丽的背后是网络主播寻求劳动法保护基本劳动权益的征途。经纪公司进军网络直播行业的初心也在于该行业用工关系处在劳动法调整的灰色地带,用工成本低且获利大。现行劳动法单一调整模式日益暴露出诸如网络表演用工等非典型劳动关系规范漏洞,加上从属性标准抽象化在演绎推理式的裁判逻辑中拔高了劳动关系认定难度,法院更倾向于用合同法来解决网络直播用工纠纷。为保护网络主播等自治性劳动者的基本劳动权益,今后可以考虑两种立法体例,或是转变劳动法调整模式,采用三分结构增设类似劳动者制度,扩大调整对象,或是保持劳动法体系的稳定,专门制定下位法,规范网络直播用工关系。     

“We feel that our strength is on the factory floor”: Dualism,shop-floor power,and labor law reform in late apartheid South Africa

ABSTRACT

This article explores the transformation of South African labor relations during the 1980s. In 1979, prompted by new shop-floor militancy, the Wiehahn Commission recommended that black workers, previously excluded from state labor machinery, be permitted to join recognized trade unions. Most discussions of this shift in apartheid labor relations focus on the ensuing debate within the black unions, torn between preserving their independence or securing state legitimation. This article looks instead at the related debate about ‘levels of bargaining’: should emergent black unions demand to negotiate at the factory level, where they had secured shop-floor strength through organizing and democratic practice, or pursue the benefits of the corporatist bargaining structures that had long excluded them and had privileged white workers? The eventual drift towards corporatism, I argue, imprinted the character of the South African labor movement into the post-apartheid era. An understandable desire to wield influence at the level of the national political economy eroded the tradition of workers’ control, shop floor democracy, and struggle unionism that black unions had forged during the 1970s and 1980s.

台湾问题是中国的内政问题，1949年新中国成立以来，中国共产党与中国国民党围绕台湾问题进行了长达30年的武力对峙。在新中国成立的第一个30年内，对台政策是中国政府内政、外交生活的重要主题之一。数十年来，国内外学者对这一时期的两岸关系、对台政策、中美关系等进行了较为深人、丰富、细致的研究，为改革开放新时期“一国两制、和平统一”政策的出台，奠定了思想、政治和理论基础。     

Playing the fool in the territory of memory: Jaan Kross' autobiographical fictions of the twentieth century

A study was conducted among young Latvians to test the effects of different conceptualizations of Latvian national identity on group beliefs and on attitudes towards Russians. It was hypothesized that exposure to inclusive discourse presenting Latvia as a multicultural society rather than an ethnic homeland would have a direct negative effect on feelings of vulnerability, injustice, distrust, superiority and helplessness with regard to the Latvian nation and a positive effect on attitudes towards Russians. The hypothesis was tested in one survey study conducted in Riga among ethnic Latvians (N?=?150).     

马克思劳动关系理论与全球劳动关系的演变

马克思的劳动关系理论对于20世纪80年代以来全球劳动关系的演变过程具有很强的解释力,劳动关系内部权力结构及处理机制所发生的变化使劳动关系出现了极其严重的权力与利益分化,当代劳动关系的复杂性远远高于马克思所描述的19世纪的资本主义劳动关系。在马克思提出的劳动关系的理想模型中,不存在由劳权缺失所引发的矛盾、冲突与分化。在这种理想的劳动关系尚未实现的情况下,劳权保护机制是不能缺失的。在劳动关系内部,保护雇佣劳动者劳权的唯一途径依然是减弱资本优先权和管理优先权对劳动关系的过度控制。在劳动关系外部,完善的公共保障体系则能够同时保护雇佣劳动者和非雇佣劳动者的劳权。随着非雇佣劳动者数量的增长,劳权保护将对公共保障体系形成更多的依赖。     

Integration or Black Power?

Integration politics experienced a postcolonial crisis in the late 1960s. This was a crisis driven by the simultaneous and inter‐related eruption of Powellism and Black Power. This article uses the crisis of integration politics to show the Powellite conjuncture from its other side, as it played out in the reconstitution of black British politics. It shows how black activists responded to the rise of Powellism by demanding that the politics of integration be either abandoned or reframed, to more fully shake out the colonial inheritances that lurked within it. The integration proposed by the postwar project of race relations was problematic from its inception; Black Power used Powell's intervention to expose these problems and demand change.     

绿色发展视角下的健康适度劳动问题

推行绿色发展战略是国际经济发展的新趋势,也是我国经济良性发展、实现十九大所提出的"两步走"战略目标的必然选择。发展绿色经济离不开其价值源泉——绿色劳动,绿色劳动的思想可以追溯至亚当·斯密、马克思和舒尔茨,ILO的体面劳动、企业社会责任、现代化、知识经济、现代社会保障都蕴含着绿色劳动的思想。目前我国在社会劳动领域存在很多问题,推动劳动的健康绿色化,需要政府积极地引导推动、企业树立新的用人理念、工会努力发挥有效维权的作用,并需要多方面借鉴国际有效经验。     

“互联网 +”时代外卖骑手薪酬探究

外卖骑手撑起整个"宅经济",但却身份不明,雇主不详。专送、外包、众包等模式将原本典型的劳动关系搅混,各用工主体试图回避劳动基准,模糊骑手薪酬,以计件制代替小时工资制,以用户评价主导业绩考核,以罚代管,肆意剥削压榨骑手。骑手薪酬设计弊端重重:劳动关系不明、社会保障缺位、用户评价失灵、企业处罚不当、计件薪酬粗暴。合理的薪酬制度是劳企和谐的基础,是提高劳动就业质量的前提。为改善行业混乱现状,政府应及时介入市场,厘清模糊不清的用工关系,适时出台行业管理标准,规范劳动定额管理,完善薪酬支付体系,保障骑手劳动权益,促进新业态良性发展。
