In this study, we explore the long‐term effectiveness of the mediation of hierarchical workplace conflicts by comparing and analyzing participants’ perceptions of short‐term and long‐term mediation effectiveness. Specifically, we surveyed supervisors and subordinates to determine the extent to which they perceive mediation to be effective one year after the conclusion of the process. In this study, we distinguish between mediations that result in a continuing employment relationship versus exit mediations, which occur when employees end their employment. We collected data from real workplace mediation cases in the Netherlands. Our results show a general positive relationship between short‐term and long‐term mediation outcomes. Supervisors and subordinates, however, perceive the long‐term outcomes somewhat differently, with supervisors perceiving greater compliance with the agreement than did subordinates after one year. We found no significant difference in perceptions of long‐term effectiveness between exit and nonexit mediations. In the article, we discuss the implications of our findings for mediation theory and practice.  相似文献

In the UK the rules governing caretaker situations have historically been underspecified. The UK's constitutional traditions, such as prime ministerial discretion to time elections and its two‐party system, have in the past limited the frequency and duration of caretaker periods. However, the recently lengthened election timetable, new constraints on the executive introduced by the Fixed‐term Parliaments Act (2011), and a decline in the dominance of the two largest parties are raising the risk that the UK will experience caretaker periods more often and for longer stretches of time. In this paper, we offer an analysis of the UK's current caretaker provisions and conclude that the existing conventions are insufficiently detailed and can render such periods problematic and controversy‐prone. Important lessons, we suggest, can be learned from reforms in other Westminster systems, and from the caretaker rules of other countries.  相似文献

死刑替代措施就是在不适用死刑的情况下应该采取的、用来代替死刑的刑罚方法。死刑替代措施应以现行刑罚体系为基础,以废除或限制死刑实际适用为前提进行考察,选择能够直接担当"最严厉"法定刑角色,保持足够的威慑力的刑种。死缓不是刑罚种类意义上的死刑替代措施;不得假释的终身监禁不符合"人总是可以改造的"的基本理念;无期徒刑是中国刑罚体系中仅次于死刑的刑种,蕴含有较强的威慑力,通过适当改良,能够产生足够的类似于死刑的威慑力。作为替代死刑的方法,设置无期徒刑先予关押期是上乘选择。考察无期徒刑在有期徒刑与死刑中的衔接地位,借鉴国外实际执行无期徒刑的经验,确定10年的先予关押期较为适宜。  相似文献

This article considers both the Fixed‐term Parliaments Act 2011 (FTPA) and the political constitution, to place the former in its political and constitutional context. It begins by setting out the background to the FTPA – which was a part of a Coalition agreement – and considers difficulties with the most commonly‐made arguments in favour of fixed‐term parliaments. The second part of the article considers the impact and potential practical legal consequences if the FTPA is repealed without any replacement, arguing that it will only be possible to revive the ‘dissolution’ prerogative by express words in a new Act. The final part of the article addresses the question of whether the prerogative should be revived, before arguing both that it should not and that a statutory power to call an election should be conferred on the Prime Minister subject to a vote by simple majority in the House of Commons.  相似文献

Translation of legal terms, as the linguistic transfer and reconstruction of sign meanings with legal concepts, holds both the symbolic nature of language and the professionalism of law. This paper finds that two intra-semiotic subjective links are identified within the process of formulation, interpretation, translation and reception of legal terms, and analyzes the five translation principles of legal terms within the semiotic interpretation from Semantic Triangle Model, and Translation Triangle Model as well as its corresponding three elements — namely, Representation, Reference and Interpretant. In addition, it is suggested that corpus, by capturing micro translation features, has the guiding and nurturing significance for translation principles of legal terms and general legal translation.  相似文献
