From an EU point of view, most international environmental agreements are mixed. This means that both the European Community (EC) and its member states are party to the agreement. As the participation of the EC in international negotiations and agreements is properly arranged by the Treaty establishing the European Community, but the EU member states’ participation is not legally organized on the EU level, the internal decision-making process regarding mixed agreements is rather complicated. Insights into this process are needed to understand the representation and the role of the European Union in international environmental negotiations. This article clarifies the legal framework of the EU decision-making process regarding such negotiations.

自新中国成立以来,中国食品安全管理体制经历了一个怎样的历史变化过程?从历史制度分析的方法论出发,如何从监管者、监管对象以及监管过程三个角度来界定这样的历史变化过程?现行的食品安全监管体制绩效如何?根据不同时期食品安全管理主体、对象以及政策工具的差异,将建国以来我国食品安全管理体制区分为指令型体制、混合型体制与监管型体制三个阶段,同时对不同阶段的发展脉络、具体特征以及体制利弊进行了归纳总结。此外,选择了四个具有代表性的指标,对1990年至今的中国食品安全变化态势进行了测量,发现我国食品安全的形势经历了一个明显的V型曲线发展过程,并据此对这一过程提出自己的解释假设,以此为中国食品安全监管的历史和现状提供一个白描式的描述图景。结合历史制度主义的分析范式,从四个方面综合分析出制约中国食品安全监管绩效优化的四大结构性因素,从而将其监管绩效的现状与历史制度根源联系起来,提出未来中国食品安全监管体制的改革方向。 相似文献

Concurrent methods for identification of urine as being of human origin, and for DNA-typing from small stains of human urine were examined. A urine stain was extracted with phosphate-buffered saline (PBS), and the extract was filtered using a Centricon-100 device. The filtrate was subjected to electrospray ionization liquid chromatography-mass spectrometry (ESI-LC-MS) for identification of human urine and a DNA-typing sample was obtained by dialfiltration of the residue using a DNA purification kit. After the purified residue was treated with an AmpflSTR Profiler PCR amplification kit, the DNA-types were analyzed by capillary electrophoresis using a Genetic Analyzer. It was possible to identify a urine stain as being of human origin, and complete DNA profiles could be successfully obtained from a urine stain which had been created by 50 microL of female urine. Serial analyses of urine stains found at a crime scene provide effective information for forensic investigation. 探讨应用荧光标记STRs复合扩增技术能够检测出混合血样品中较少个体成份的最低检出量及所占的比例多少与基因型的峰值高低是否存在一定的剂量反应关系。采用荧光标记STRs复合扩增技术 ,分析 4对两无关男 /女的混合血样品。扩增基因座包括D8S1179、D2 1S11、D18S5 1、D3S135 8、vWA、FGA、D5S818、D13S317、D7S82 0及性别Amelogeine。结果表明 ,对经用酚 /氯仿有机溶剂方法提取的混合血样品中较少成份的最低检出量为 ,能够从10ng混合DNA中检出 1ng的较少成份 ;从 10∶90至 5 0∶5 0 5个不同比例组 ,较少成份所占比例多少与其对应基因型峰值的高低呈现一定的正相关趋势。应用荧光标记STRs复合扩增技术可能较好地解决混合血样品的个体识别问题 相似文献

在自由主义和民主主义结盟反对封建主义的历史进程中,形成了一套关于国家建构的系统学说。香港并非国家,但这套学说却在香港社会关于特别行政区立法会功能角色的讨论中拥有不小的影响力。片面强调"两制"差异,以自由主义代议制学说描摹一个地方行政单位的立法机构,终将沿着这套学说的国家建构逻辑挑战"一国"之本。本世纪初以来,香港特别行政区立法会出现内部对立、扩权,职能上轻立法、重监督的趋势和现象,与这种学说在香港社会的影响不无关系。就解决历史遗留的香港问题而言,"一国两制"是各方都能接受的"最大公约数",讲求平衡政府原则、混合政体设计的共和精神较契合香港特别行政区的这一政治现实,或可成为引导特别行政区立法会变革的方向之一。 相似文献

ABSTRACTInterracial marriage was a defining feature of interaction between local Ngāi Tahu and newcomers in southern New Zealand from the early nineteenth century. Scholarship has explored the importance of such relationships to development of New Zealand’s early resource-based economies and to colonial assimilation policies. However, the experiences of cross-cultural households and families in colonial New Zealand are less well documented.Using a body of writing produced by fathers and their mixed-race children in response to land claims investigations in the mid-nineteenth century, this article explores the political, economic and social world of interracial families in southern New Zealand. The correspondence over land rights reveals the ongoing importance of kinship ties through generations as colonial expansion impinged on these communities. Through petitioning and letter writing, fathers and children contested what marriage and family meant and strategically asserted their individual and collective identity in the face of increasing land dispossession and economic hardship. 相似文献

Under ideal conditions, when do voters switch from sincere to strategic voters? Despite a large literature on strategic voting and Duverger’s Law, few studies assess when individuals shift from sincere to strategic nor what factors may encourage or discourage defecting from one’s first choice. Through an experimental web survey analysing district voting in South Korea’s National Assembly, this study measures the effect of partisan cues and the margin of error. Not only did a non-negligible number of respondents remain sincere voters despite conditions favourable to strategic voting, but supporters of smaller parties and those without partisan identification were more likely to defect from their sincere vote when given an additional prompt about the margin of error. The results suggest the contextual influence on the strategic vote calculus. 相似文献

This article explores the barriers to implementing mixed-income development plans that incorporate the social (income) and physical (new urbanism) mixing goals of HOPE VI. I examine a comparative case study of three HOPE VI planning efforts in Chicago, Illinois, that exhibit different results. I draw from 25 in-depth interviews across three primary types of actors involved in the development process: developers, housing officials, and consultants. This research uses the perspectives of these key actors to identify the barriers that constrain the implementation of new urbanist designs. Current research indicates that mixed-income developments vary in their degree of income mixing and how new urbanist strategies are implemented. However, there is little consensus on why this is so. Findings indicate implementation of new urbanism is constrained by limited interagency coordination, restrictive design policies, low community buy-in, and exclusive marketing and occupancy practices. Overall, the research offers lessons learned from which I recommend changes in planning practices to assist actors in the consistent implementation of new urbanism in mixed-income developments. 相似文献
