Gender aspects of inheritance strategies and land transmission in rural Scania,Sweden, 1720–1840

This study deals with gender aspects of land transmissions in pre-industrial Sweden. Although not supported by law, a clear mentality of male primogeniture among peasants existed in the Swedish countryside in the 18th century. In many cases, however, this ideal could never be realized, making the idea of the “family farm,” handed down from father to son for generations, more of a myth than a reality. This study uses postmortem inventories linked to tax registers and family reconstitutions for a sample of parishes in southern Sweden to show that various strategies were chosen when transferring the farm after the death of the husband or wife. Although sons were more likely to take over the farms, daughters (or more correctly sons-in-law) also frequently did so, as did, sometimes, more distant kin and non-kin. Moreover, it was not the case, as has sometimes been maintained, that daughters took over the farm only when no able-bodied sons were available. On the contrary, daughters (sons-in-law) quite frequently took over the farm even when sons were present. The decision on land transmission was part of a more general family strategy concerning reproduction (access to marriage and household formation) as well as old-age security.     

Developing a Model Intervention to Prevent Abuse in Relationships Among Caribbean and Caribbean-American Youth by Partnering with Schools

SUMMARY

This paper proposes a model intervention to prevent relationship abuse among Caribbean and Caribbean-American adolescents. Specifically, the model partners with a high school with a strong Caribbean student population and incorporates education, prevention and intervention, as the three core components. This paper highlights the importance of working with young people in a school setting, working with young people before they have fully tackled the developmental task of defining norms of and values in relationships, utilizing culturally competent staff and specialized programming, and emphasizing the need for early intervention in the instances of adolescent relationship violence before its evolution into adult domestic violence. The model proposed serves as an outline for further development of culturally-specific and competent interventions to prevent and address relationship violence among adolescents.

自18世纪末中国帆船对吧城、马尼拉的贸易逐渐衰退之后,到19世纪初期依然没有摆脱持续衰落的困境。与此同时,暹罗及安南的王朝兴替,则在一定程度上遏制了中国帆船对两国贸易衰退的势头,并促使彼此间贸易往来在19世纪初期再度兴旺起来。19世纪初期英国在据有新加坡之后所采取的自由贸易政策,使得中国帆船的东南亚贸易又迎来一个新的发展机遇。对于中国帆船的东南亚贸易而言,18世纪末至19世纪初可谓是一个危机与机遇并存的时代。

Prüfung des Gesuchs auf Verbücherung eines Bestandrechts

Die Rechtswirkungen der Verbücherung eines Bestandrechts beschr?nken sich auf die Folgen der §§ 1120 f ABGB. Eine allgemeine dingliche Wirkung gegenüber dritten Personen kommt der Eintragung des Bestandrechts nicht zu. Die Prüfung eines Gesuchs auf Eintragung eines Bestandvertrags hat nach den Erfordernissen der §§ 26 ff GBG zu erfolgen und muss insb dem § 32 GBG genügen. Ma?geblich und ausreichend ist, dass die Mieterin als Antragstellerin und die Eigentümerin und Vermieterin des Bestandobjekts genannt sind, ob welchem der Bestandvertrag eingetragen werden soll und auf den sich das Bestandverh?ltnis – zumindest auch und insoweit jedenfalls rechtlichm?glich und zul?ssig – bezieht. Sind diese Anforderungen erfüllt, hat die Eintragung des Bestandvertrags zu erfolgen. Ob die durch den Bestandvertrag einger?umte Nutzungsm?glichkeit im gesamten Umfang durch die Rechtsstellung des Vermieters gedeckt ist, ist dagegen nicht Teil der grundbuchsrechtlichen Prüfung.

Das Recht des Werbekostenabzugs für Mietobjekte h?ngt nicht vom Vorliegen einer (kleinen oder gro?en) Bauherreneigenschaft ab. Die Kosten der Finanzierung, der steuerlichen Beratung, der Mieterakquirierung und der überwachung des Mieteneingangs sind (soweit es sich nicht um verdeckte Grundstücksvermittlungsprovisionen handelt, die aktivierungspflichtig w?ren) stets Werbungskosten. Kosten der Baubetreuung, Kontrolle der Baurechnungen, Kaufvertragskosten bzw Kosten der treuh?ndigen Kaufpreisabwicklung sind hingegen stets aktivierungspflichtige Anschaffungs- oder Herstellungsnebenkosten.
