我国法治实践的若干法律问题

随着我国“建设社会主义法治国家”宏伟目标的明确提出,我国的法治进程得到不断推进。但是,“人治”观念的影响、民主政治的不健全、道德与法律在法治进程中同时并存、法律移植与本土化的矛盾、乡土社会实施法律的艰难以及法的实效的不理想却造成我国法治进程比较缓慢。因此,我国应加强“法治”观念,真正使民主制度法律化,正确处理道德与法律、法律移植与本土化之间的关系,促进国家法在乡土社会的实施,尽量通过提高立法技术等措施保证法功能、目的的实现,进而使我国的法治建设取得更大的成效。     

法律职业中的女性

女性参与法律职业的历史告诉我们,女性曾经被拒之于法律职业的门外。但是经过相当长时间的历史发展,现在女性人数在司法界快速增长,比例提高,女性在法律职业和法学研究中的地位不断提高,从而使更多的女性价值和女性经验得以实现。女性及女性思维给法律和司法带来了新鲜空气和变革力量,法律和司法的形象和理念也在发生微妙的变化。     

国家法难行之源：国家主义抑或人本主义——从“依法收贷案”切入

以前有关“依法收贷案”的研究文章都认为这里的“法”就是“现行国家法”,但对此案细致分析发现并非如此,而是“王法”即中国传统法。中国国家法自古至今有一种严重的国家主义倾向（而今表现为一种现代化倾向）,缺乏一种现代法律所需要的人本主义精神因素,因此,国家法只得到了国家外部力量的推动,缺乏内部力量的驱动,其社会化动力不足。其社会化程度远低于中国传统的“法”与“德”,最终被“王法”置换,为中国传统的“德”所打败。     

The relationship between law and morality

Law and morality can be considered as two competing groups among varied and sophisticated social phenomena. Both law and morality serve as norms of human behavior and fall in the category of values for maintaining social welfare. The study was based mainly on a review of the relevant literature and the compiling of available information on law and morality. This paper argues that law and morality are closely related yet distinct.     

Kant’s Project of Perpetual Pacification

Richard Tuck locates a conundrum in the Hobbesian world view. Whereas the nation-state is desired to effect the pacification of the domestic sphere, a world state and the promise of global pacification is feared. Kant’s strong program for perpetual peace is presented as a moral imperative to establish through legal means a world republic based on reason and individual autonomy. Kant emphasizes the empirical impossibility of a world republic and hence advocates the weaker program of a world federation of states. This essay argues not the empirical but the logical impossibility of Kant’s strong program and by extension any program of perpetual peace that claims to be essentially different from ‘mere’ peace as truce. In so doing this essay distinguishes between political theory based on the assumption of the ontological priority of peace and political theory based on the assumption of the ontological priority of violence and argues for the necessity of thinking the latter.

关于网络伦理的思考

阐述了网络社会的特点以及网络带来的伦理问题 :道德冷漠、人际情感疏离、网络安全问题、计算机犯罪、信息垄断。分析了网络伦理问题产生的根源 ,并提出了加强网络伦理建设的措施。     

道德,道德教育及其受用性

道德有许多功能,也就是说有许多“用”。它可以利他与自利。除此以外,它本身对它的主体也生出一种“用”,这种用不是外在的利益,而是一种感受,是一种“受用”。这种受用是乐。道德具有乐之受用,这是儒学中的基本观念。教育具有乐之受用亦是儒学基本观念。道德有乐之受用,教育亦有乐之受用。二合而为一,道德教育本身之乐趣,便益发彰显。     

论领导干部要常修为政之德

在改革开放和发展社会主义市场经济条件下,我国社会经济发展产生了广泛而深刻的变化,社会经济成份、组织形式、利益分配和就业方式等都出现了许多新的情况和新的问题,个别领导干部的世界观、人生观、价值观、利益观产生扭曲,有的人在腐朽思想文化的侵蚀下自我陶醉,贪图安逸,追逐名利。由于领导干部的道德水平如何,直接影响党在人民群众心目中的形象与威望,影响全面建设小康社会的推进。因此,领导干部要注重从政道德修养,也要做官先做人,更要为官重修德。     

The understanding of the laws and bylaws and the methodology for drafting in the socialist regime

The methodology for drafting is one of the most important concepts in drafting of a policy paper and translating this policy into legislation. Regarding this, it is necessary to know how the legislative drafting developed in the past during the socialist regime, and how it has changed with time after the beginning of the democratic processes of the country. Due to the correct methodology of drafting, we enable a good correct legislation as an important element of good governance, where the concept of law lays on its foundations and the democratic system is the major goal.
