Corruption and Rent-Seeking

The rent-seeking theory was one of thefirst economic instruments developed tomodel corruption in the public sector.Comparing corruption with lobbying, itproposes that the former is the lesser oftwo evils, since lobbying entails the wastage of resources inthe competition forpreferential treatment. This study showsthat the traditional rent-seeking theorymisunderstands three factors: first, theimpact of a corrupt monopoly on the rent'ssize; second, corruption as a motivationfor supplying preferential treatment andthird; that corruption involves a narrowerrange of interests than those ofcompetitive lobbying. Taking these factorsinto consideration, the opposite argumentis valid: corruption has worse welfareimplications than alternative rent-seekingactivities.

A 55-year-old man was found unconscious with ventricular fibrillations at his working place near a power press. CPR was successful. After three weeks of intensive care the patient died of ischemic brain damage. The first suspected diagnosis of myocardial infarction was revised when typical current marks were detected on both palms. At the working place the top of a lubricating grease container was found to be energized due to a technical damage: There is a round, multiple-pole plug mounted upon the container top the proper orientation of which is coded by a set of five plastic nipples. All the nipples had been abraded by longlasting mechanical stress, so that the plug could be connected in a variety of possible orientations. In actual fact, the incorrect orientation caused a voltage of up to 240 V to the container top.     

Genehmigungs- und Aufklärungspflichten bei Zins-Swap-Geschäften von Sozialversicherungsträgern

Der Genehmigungsvorbehalt nach § 446 Abs 3 ASVG ist nicht eine blo?e Organisationsvorschrift der internen Willensbildung, sondern eine Anordnung, die die Handlungsf?higkeit der vertretungsberechtigten Organe des Sozialversicherungstr?gers auch im Au?enverh?ltnis beschr?nkt. Eine nicht durch die erforderliche ministerielle Genehmigung gedeckte Willenserkl?rung des an sich zum Vertragsabschluss zust?ndigen Organs bindet den Sozialversicherungstr?ger daher nicht (hier: Abschluss des "Quanto-Snowball-Swaps"). ?ffentlich-rechtliche K?rperschaften sind verpflichtet, den Partner durch ihre Verhandlungsführer als Erfüllungsgehilfen über die Gültigkeitsvoraussetzungen des beabsichtigten Gesch?fts aufzukl?ren, sofern diese ihrem Organ bekannt oder leichter erkennbar sind als dem Partner. Wird der Partner im guten Glauben gelassen, es bestehe keine Genehmigungsbedürftigkeit, haftet die K?rperschaft auf das Vertrauensinteresse, wenn die Genehmigung in der Folge nicht erteilt wird. Auch für Sch?den aus einer Verletzung vorvertraglicher Aufkl?rungspflichten gilt, dass nur alle ad?quaten und im Rechtswidrigkeitszusammenhang stehenden Folgen vom Normzweck mit erfasst sind. Die Kausalit?t rechtswidrigen Verhaltens reicht allein nicht zur Haftungsbegründung aus. Die übernahme des Risikos aus einem Vertrag, der vom anderen Teil mit Dritten abgeschlossen wurde, ist nur ausnahmsweise vom Schutzzweck des Grundverh?ltnisses erfasst. Umst?nde, die erst nach Vertragsabschluss erkennbar waren und die der Schuldner bei Eingehen der Verpflichtung nicht berücksichtigen konnte, dürfen ihm auch nicht unter dem Gesichtspunkt des Schutzzwecks zum Verh?ngnis werden. Wenn der gesch?digte Vertragsteil mit der bedungenen Leistung Interessen verfolgt, die nicht mehr in der Leistung selbst liegen und daher vom üblichen Entgelt nicht abgedeckt werden, und überdies der Eintritt des Folgeschadens noch von einem Entschluss eines Dritten abh?ngig ist, der h?ufig kaum vorhersehbar ist, muss eine Zurechnung verneint werden. Mit dem Schutzzweck des Genehmigungsvorbehalts nach § 446 Abs 3 ASVG w?re es unvereinbar, dass der Sozialversicherungstr?ger zwar nicht das eigene Spekulationsgesch?ft, aber jenes, das vom anderen Teil mit einem Dritten abgeschlossen wurde, erfüllen müsste. Eine hohe Professionalit?t des Kunden kann nicht ausschlie?en, dass er im Einzelfall bezüglich eines bestimmten Gesch?fts einer Fehlvorstellung unterliegt. Auch ein versierter Gesch?ftspartner darf nicht in die Irre geführt werden. Die Erw?gungen des BGH zu hochkomplex strukturierten und riskanten Finanzprodukten (XI ZR 33/10x, dort: "CMS Spread Ladder Swap"), die auf die Wohlverhaltensregeln des § 31 des deutschen Wertpapierhandelsgesetzes gestützt wurden, k?nnen in Grundzügen auch nach ?sterr Recht Beachtung finden, wenn es sich um ein komplex strukturiertes Produkt handelt, dem ein der H?he nach kaum kalkulierbares, aber schon wegen eines einseitigen Kündigungsrechts asymmetrisch verteiltes Risiko anhaftet (hier: "Quanto-Snowball-Swap").     

Unity in the face of threat? Exploring the empirical relationship between strategic threat perceptions and public support for a common European army in Germany

ABSTRACT

Perceptions of threat from Russia’s military activities in Ukraine and President Trump’s critical attitude towards NATO have put the idea of a common European army on the agenda of European politics. Do these strategic threat perceptions also influence public support for the creation of a common European army? Previous research has largely overlooked strategic threat perceptions as individual-level determinants of public support for a common European army. This article explores the empirical relationship between strategic threat perceptions and support for a common European army at the individual level of analysis with representative German survey data from 2018. The multivariate analysis shows that perceiving Russia’s military activities in Ukraine as a threat to Germany’s security, and U.S. foreign and security policy as a threat to the cohesion of NATO significantly increases support for the creation of a common European army, even when the influence of numerous other determinants is controlled for. The findings highlight the importance of considering strategic threat perceptions in future analyses of public opinion on European defence cooperation and integration.     

Corrupt intermediaries in international business transactions: between make, buy and reform

Attempts to deter corruption have little recognized the operation of intermediaries. This study takes a New Institutional Economic-perspective, supported by a variety of case studies, to identify firms’ choices of when to engage corrupt intermediaries (buy) and how to approach reform. It argues that firms should be held unbendingly liable for the operation of their intermediaries. Reform may also focus on certifying “good” intermediaries and holding the certifier liable for the performance of its agents. Prohibiting intermediaries is not advisable, as intermediation can be either arranged in-house (make) or mixed with legal services. Registration and auditing of intermediaries provides a more promising avenue for reform. Legislators should balance the additional regulatory burden by granting a wage premium to registered intermediaries and denying legal recourse to unregistered competitors.     

Attention to Counter-Attitudinal Messages in a State Election Campaign

Research following the "selective exposure" model has focused on avoidance of political messages with which a person might disagree. But positive attention to such "counter-attitudinal" messages is worthy of study, in part because normative theories of democracy value exposure to information that might disturb citizens' political predispositions. Surveys of youth (N = 417) and parents (N = 430) examine attention to newspaper, television, and Web messages about candidates. While there is somewhat more attention to messages about and for a person's favored political candidate or party, forms of political involvement (knowledge, curiosity, and discussion) that predict this "attitude-consistent" attention also predict counter-attitudinal attention at least as strongly. Parents' education and students' exposure to civics lessons also predict both kinds of attention. These results suggest that attention to counterattitudinal political messages is worthy of further study as an important goal of political socialization and a criterion of citizen performance in democracy.     

Gendered Pathways to Bullying Perpetration via Social Achievement Goals – Mediating Effects of Sense of Belonging and Non-inclusive Group Norms

ABSTRACT

This study investigated the gender-specific effects of social achievement goals – i.e., social development goals, social demonstration approach goals, and social demonstration avoid goals – on bullying perpetration in a sample of 788 adolescents (53.3% girls), taking into account the mediating role of sense of belonging and non-inclusive group norms. Two-group structural equation modeling results indicated that social demonstration approach goals positively predicted bullying perpetration for both genders. For girls, higher social development goals and for boys, higher social avoidance goals decreased bullying perpetration. Gender-specific effects of belonging and non-inclusive group norms on bullying perpetration occurred. For boys, non-inclusive group norms mediated the relation between all social achievement goals and bullying perpetration. Implications for future research and (gender-sensitive) bullying interventions are discussed.

Relativ selten hat das H?chstgericht Gelegenheit, zu Fragen Stellung zu nehmen, die sich im Zusammenhang mit dem Kontrahierungszwang stellen, dem der Monopolist nach hA unterliegt. Daher darf es nicht verwundern, dass hier noch keineswegs alle Fragen als hinreichend gekl?rt angesehen werden k?nnen. Dies belegt deutlich die jüngste Entscheidung des OGH zu diesem Thema, die E 1 Ob 143/10a, in welcher das H?chstgericht mit einem Fall befasst war, in dem sich die Monopolfrage im Zusammenhang mit Vertr?gen über die Versorgung mit Wasser stellte, der OGH aber – wie argumentiert werden soll – die sich aus der Monopolstellung des Anbieters ergebenden rechtlichen Konsequenzen nicht in allen Aspekten zutreffend bestimmte.
